Amends the Counties Code. Adds a Section providing that a county board of any non-home rule county may tax and regulate places for eating, amusement, theatricals, and other exhibitions, shows, and amusements in unincorporated areas of the county developed pursuant to a special use and subject to the local land resource management plan. Provides that a county board of any non-home rule county may enter into intergovernmental agreements with any one or more adjoining municipality for the purpose of implementing these taxes and regulations. Amends the Municipal Code. Provides that a municipality may enter into an intergovernmental agreement with a county to implement these taxes and regulations. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Counties Code is amended by adding Section |
| 5 | | 5-1058.5 as follows:
|
| 6 | | (55 ILCS 5/5-1058.5 new) |
| 7 | | Sec. 5-1058.5. Taxing and regulation of places for eating |
| 8 | | and amusement; unincorporated areas of non-home rule counties. |
| 9 | | The county board may tax and regulate places for eating, |
| 10 | | amusement, theatricals, and other exhibitions, shows, and |
| 11 | | amusements in unincorporated areas of the county developed |
| 12 | | pursuant to a special use, as defined in Section 5-12009.5 of |
| 13 | | the Counties Code, and subject to a local land resource |
| 14 | | management plan, as authorized under the Local Land Resource |
| 15 | | Management Planning Act. The county board may, but is not |
| 16 | | required to, enter into an intergovernmental agreement with any |
| 17 | | one or more municipalities for the purpose of implementing the |
| 18 | | provisions in this Section.

| 19 | | Section 10. The Illinois Municipal Code is amended by |
| 20 | | adding Section 11-42-5.5 as follows:
