3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Public Officer Prohibited Activities Act is |
5 | | amended by adding Section 5 as follows: |
6 | | (50 ILCS 105/5 new) |
7 | | Sec. 5. Ban on promotional materials. |
8 | | (a) This Section applies to all units of local government, |
9 | | local officials, school districts, and public institutions of |
10 | | higher education, as that term is defined under Section 2 of |
11 | | the Higher Education Cooperation Act, which includes community |
12 | | colleges. This Section also applies to all employees of a unit |
13 | | of local government, a local official, school district, or |
14 | | public institution of higher education, and persons or |
15 | | contractors working on behalf of a unit of local government, a |
16 | | local official, school district, or public institution of |

1 | | higher education. |
2 | | (b) No person or entity to which this Section applies shall |
3 | | use public moneys to send any promotional materials to |
4 | | residents, except those directly related to course offerings, |
5 | | programs of study, or certificate or degree programs, including |
6 | | information regarding tuition and expenses, during the |
7 | | following periods: |
8 | | (1) For units of local government with offices elected |
9 | | at the consolidated election, during a period beginning |
10 | | January 1 through the day after the consolidated election. |
11 | | (2) For all other units of local government, during a |
12 | | period beginning February 1 of the year of a general |
13 | | primary election and ending the day after the general |
14 | | primary election and during a period beginning September 1 |
15 | | of the year of a general election and ending the day after |
16 | | the general election. |
17 | | (c) The restrictions imposed under this Section do not |
18 | | apply to bills, schedules of events, or course-related |
19 | | materials, including financial aid. |
20 | | (d) Any person who violates this Section is subject to the |
21 | | penalties set forth in Section 4 of this Act, including |
22 | | termination of employment. ".
