2 | | AMENDMENT NO. ______. Amend Senate Bill 904 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The State Budget Law of the Civil |
5 | | Administrative Code of Illinois is amended by changing Section |
6 | | 50-22 as follows: |
7 | | (15 ILCS 20/50-22) |
8 | | Sec. 50-22. Funding for salaries of General Assembly |
9 | | members , State employees, and judges; legislative operations. |
10 | | (a) Beginning July 1, 2014, the aggregate appropriations |
11 | | available for salaries for members of the General Assembly and |
12 | | judges from all State funds for each State fiscal year shall be |
13 | | no less than the total aggregate appropriations made available |
14 | | for salaries for members of the General Assembly and judges for |
15 | | the immediately preceding fiscal year. |
16 | | (b) Beginning July 1, 2014, the aggregate appropriations |

1 | | available for legislative operations from all State funds for |
2 | | each State fiscal year shall be no less than the total |
3 | | aggregate appropriations made available for legislative |
4 | | operations for the immediately preceding fiscal year. For |
5 | | purposes of this subsection (b), "legislative operations" |
6 | | means any expenditure for the operation of the Office of the |
7 | | Auditor General, the House of Representatives, the Senate, the |
8 | | Legislative Ethics Commission, the Office of the Legislative |
9 | | Inspector General, the Joint Committee on Legislative Support |
10 | | Services, and the legislative support services agencies. |
11 | | (b-5) Beginning July 1, 2015 and continuing through June |
12 | | 30, 2016, there is hereby appropriated to each State agency |
13 | | from the applicable State funds, on a continuing basis, the |
14 | | amount necessary for personnel expenditures of the State |
15 | | agency, as jointly certified by the State agency and the |
16 | | Governor's Office of Management and Budget, for each payroll |
17 | | period during which appropriations for personnel expenditures |
18 | | have not been made available to the State agency for Fiscal |
19 | | Year 2016. |
20 | | A continuing appropriation provided by this subsection |
21 | | (b-5) is authority, and not an obligation, to expend up to the |
22 | | amount appropriated. A continuing appropriation provided by |
23 | | this subsection (b-5) does not confer any right or expectation |
24 | | on any person, group, or entity in continued employment or the |
25 | | payment of personnel expenditures. This subsection (b-5) does |
26 | | not affect the establishment of particular wages, salaries, or |

1 | | other personnel expenditure amounts. |
2 | | For the purposes of this subsection (b-5): |
3 | | (1) "State agency" means the office of any |
4 | | constitutional officer of the State government and any |
5 | | agency, authority, board, commission, department, State |
6 | | university, or other instrumentality of the State |
7 | | government to which an appropriation for personnel |
8 | | expenditures from a State fund was made in Fiscal Year |
9 | | 2015, or under which personnel expenditures were paid in |
10 | | Fiscal Year 2015. "State agency" also includes any |
11 | | community college district. |
12 | | (2) "Personnel expenditure" means an expenditure for |
13 | | personal services, group insurance for employees paid out |
14 | | of funds other than the General Revenue Fund, State |
15 | | contributions to Social Security, and State contributions |
16 | | to a State retirement system, other than an expenditure |
17 | | described in subsection (a) or (b) of this Section. |
18 | | (3) "Applicable State fund" means, with respect to a |
19 | | State agency, the General Revenue Fund or other State fund |
20 | | from which moneys were appropriated in Fiscal Year 2015 to |
21 | | the State agency for personnel expenditures. |
22 | | (c) If for any reason the aggregate appropriations made |
23 | | available are insufficient to meet the levels required by |
24 | | subsections (a) , and (b) , and (b-5) of this Section, this |
25 | | Section shall constitute a continuing appropriation of all |
26 | | amounts necessary for these purposes. The General Assembly may |
