AMENDMENT TO SENATE BILL 793

2    AMENDMENT NO. ______. Amend Senate Bill 793 as follows:
 
3on page 1, immediately below line 3, by inserting the
4following:
 
5    "Section 3. The Department of Public Health Powers and
6Duties Law of the Civil Administrative Code of Illinois is
7amended by changing Section 2310-252 as follows:
 
8    (20 ILCS 2310/2310-252)
9    Sec. 2310-252. Guidelines for needle disposal; education.
10    (a) The Illinois Department of Public Health, in
11cooperation with the Illinois Environmental Protection Agency,
12must create guidelines for the proper disposal of hypodermic
13syringes, needles, and other sharps used for
14self-administration purposes that are consistent with the
15available guidelines regarding disposal for home health care

1products provided by the United States Environmental
2Protection Agency. In establishing these guidelines, the
3Department shall promote flexible and convenient disposal
4methods appropriate to the area and level of services available
5to the person disposing of the hypodermic syringe, needle, or
6other sharps. The Department guidelines shall encourage the use
7of safe disposal programs that include, but are not limited to,
8the following:
9        (1) drop box or supervised collection sites;
10        (2) sharps mail-back programs;
11        (3) syringe exchange programs; and
12        (4) at-home needle destruction devices.
13    (b) The Illinois Department of Public Health must develop
14educational materials regarding the safe disposal of
15hypodermic syringes, needles, and other sharps and distribute
16copies of these educational materials to pharmacies and the
17public. The educational materials must include information
18regarding safer injection, HIV prevention, proper methods for
19the disposal of hypodermic syringes, needles, and other sharps,
20and contact information for obtaining treatment for drug abuse
21and addiction.
22    (c) As soon as practicable after the effective date of this
23amendatory Act of the 99th General Assembly, the Department of
24Public Health shall review and, if necessary, revise the
25guidelines and educational materials developed pursuant to
26this Section so that those guidelines and materials inform

1members of the public about the prohibitions under Section 56.1
2of the Environmental Protection Act."; and
