1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-371.5 as follows:
 
7    (20 ILCS 2310/2310-371.5)  (was 20 ILCS 2310/371)
8    Sec. 2310-371.5. Heartsaver AED Fund; grants. Subject to
9appropriation, the Department of Public Health has the power to
10make matching grants from the Heartsaver AED Fund, a special
11fund created in the State treasury, to any school in the State,
12public park district, forest preserve district, conservation
13district, sheriff's office, municipal police department,
14municipal recreation department, college, or university to
15assist in the purchase of an Automated External Defibrillator.
16Applicants for AED grants must demonstrate that they have funds
17to pay 50% of the cost of the AEDs for which matching grant
18moneys are sought. Any school, public park district, forest
19preserve district, conservation district, sheriff's office,
20municipal police department, municipal recreation department,
21college, or university applying for the grant shall not receive
22more than one grant from the Heartsaver AED Fund each fiscal
23year. The State Treasurer shall accept and deposit into the

1Fund all gifts, grants, transfers, appropriations, and other
2amounts from any legal source, public or private, that are
3designated for deposit into the Fund.

5    Section 10. The Counties Code is amended by adding Section
63-6040 as follows:
 
7    (55 ILCS 5/3-6040 new)
8    Sec. 3-6040. Automated external defibrillators. The
9sheriff of each county shall, in accordance with the
10requirements of the Automated External Defibrillator Act,
11ensure that:
12        (1) his or her office is equipped with an operational
13    and accessible automated external defibrillator that meets
14    the requirements of the Automated External Defibrillator
15    Act; and
16        (2) an adequate number of personnel in his or her
17    office is trained to administer the automated external
18    defibrillator in accordance with the Automated External
19    Defibrillator Act.
 
20    Section 15. The Illinois Municipal Code is amended by
21adding Section 11-1-13 as follows:

1    Sec. 11-1-13. Automated external defibrillators. The
2corporate authorities of each municipality shall, in
3accordance with the requirements of the Automated External
4Defibrillator Act, ensure that:
5        (1) each police department that employs 100 or more
6    police officers is equipped with an operational and
7    accessible automated external defibrillator; and
8        (2) an adequate number of personnel in each police
9    department is trained to administer the automated external
10    defibrillator.
 
11    Section 20. The Automated External Defibrillator Act is
12amended by changing Section 30 as follows:
 
13    (410 ILCS 4/30)
14    Sec. 30. Exemption from civil liability.
15    (a) A physician licensed in Illinois to practice medicine
16in all its branches who authorizes the purchase of an automated
17external defibrillator is not liable for civil damages as a
18result of any act or omission arising out of authorizing the
19purchase of an automated external defibrillator, except for
20willful or wanton misconduct, if the requirements of this Act
21are met.
22    (b) An individual or entity providing training in the use
23of automated external defibrillators is not liable for civil
24damages as a result of any act or omission involving the use of

1an automated external defibrillator, except for willful or
2wanton misconduct, if the requirements of this Act are met.
3    (c) A person, unit of State or local government, sheriff's
4office, municipal police department, or school district
5owning, occupying, or managing the premises where an automated
6external defibrillator is located is not liable for civil
7damages as a result of any act or omission involving the use of
8an automated external defibrillator, except for willful or
9wanton misconduct, if the requirements of this Act are met.
10    (d) An AED user is not liable for civil damages as a result
11of any act or omission involving the use of an automated
12external defibrillator in an emergency situation, except for
13willful or wanton misconduct, if the requirements of this Act
14are met.
15    (e) This Section does not apply to a public hospital.
