Japanese buckthorn (Rhamnus japonica), Chinese |
13 | | buckthorn (Rhamnus
utilis), and kudzu
(Pueraria lobata) , |
14 | | exotic bush honeysuckles (Lonicera maackii, Lonicera tatarica, |
15 | | Lonicera morrowii, and Lonicera fragrantissima), exotic olives |
16 | | (Elaeagnus umbellata, Elaeagnus pungens, Elaeagnus |

1 | | angustifolia), salt cedar (all members of the Tamarix genus), |
2 | | poison hemlock (Conium maculatum), giant hogweed (Heracleum |
3 | | mantegazzianum), Oriental bittersweet (Celastrus orbiculatus), |
4 | | and lesser celandine (Ficaria verna), teasel (all members of |
5 | | the Dipsacus genus), and Japanese, giant, and Bohemian knotweed |
6 | | (Fallopia japonica, syn. Polygonum cuspidatum; Fallopia |
7 | | sachalinensis; and Fallopia x bohemica, resp.) are hereby |
8 | | designated
exotic weeds. Upon petition the
Director of Natural |
9 | | Resources, by rule,
shall exempt varieties of any species |
10 | | listed in this Act that can be
demonstrated by published or |
11 | | current research not to be an exotic weed as
defined in Section |
12 | | 2.

15 | | Sec. 4. Control of Exotic Weeds. |
16 | | (a) It shall be unlawful for any
person, corporation, |
17 | | political subdivision, agency or department of the
State to |
18 | | buy, sell, offer for sale, distribute or plant seeds, plants or
|
19 | | plant parts of exotic weeds without a permit issued by the |
20 | | Department of
Natural Resources. Such permits shall be issued |
21 | | only : |
22 | | (1) for
experiments into
controlling and eradicating |
23 | | exotic weeds ; or |
24 | | (2) for research to demonstrate
that a variety of a |
25 | | species listed in this Act is not an exotic weed as
defined |

1 | | in Section 2 ; or .
|
2 | | (3) for the use of exotic olive (Elaeagnus umbellata, |
3 | | Elaeagnus pungens, Elaeagnus angustifolia) berries in the |
4 | | manufacture of value added products, not to include the |
5 | | resale of whole berries or seeds. The exotic berry permit |
6 | | holder must register annually with the Department of |
7 | | Natural Resources and be able to demonstrate to the |
8 | | Department that seeds remaining post-manufacture are |
9 | | sterile or otherwise unviable. |
10 | | (b) The commercial propagation of exotic weeds for sale |
11 | | outside
Illinois, certified under the Insect Pest and Plant |
12 | | Disease Act, is
exempted from the provisions of this Section.

13 | | (c) The Department of Natural Resources may adopt rules for |
14 | | the administration of this Section. |
