1 | AN ACT concerning conservation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Exotic Weed Act is amended by | ||||||
5 | changing Sections 3 and 4 as follows:
| ||||||

7 | Sec. 3. Designated Exotic Weeds. Japanese honeysuckle | ||||||
8 | (Lonicera
japonica), multiflora rose (Rosa multiflora), purple | ||||||
9 | loosestrife
(Lythrum salicaria),
common buckthorn (Rhamnus | ||||||
10 | cathartica), glossy buckthorn (Rhamnus frangula),
saw-toothed | ||||||
11 | buckthorn (Rhamnus arguta), dahurian buckthorn (Rhamnus | ||||||
12 | davurica),
Japanese buckthorn (Rhamnus japonica), Chinese | ||||||
13 | buckthorn (Rhamnus
utilis), and kudzu
(Pueraria lobata) , | ||||||
14 | exotic bush honeysuckles (Lonicera maackii, Lonicera tatarica, | ||||||
15 | Lonicera morrowii, and Lonicera fragrantissima), exotic olives | ||||||
16 | (Elaeagnus umbellata, Elaeagnus pungens, Elaeagnus | ||||||
17 | angustifolia), salt cedar (all members of the Tamarix genus), | ||||||
18 | poison hemlock (Conium maculatum), giant hogweed (Heracleum | ||||||
19 | mantegazzianum), Oriental bittersweet (Celastrus orbiculatus), | ||||||
20 | and lesser celandine (Ficaria verna), teasel (all members of | ||||||
21 | the Dipsacus genus), and Japanese, giant, and Bohemian knotweed | ||||||
22 | (Fallopia japonica, syn. Polygonum cuspidatum; Fallopia | ||||||
23 | sachalinensis; and Fallopia x bohemica, resp.) are hereby |

exotic weeds. Upon petition the
Director of Natural | ||||||
2 | Resources, by rule,
shall exempt varieties of any species | ||||||
3 | listed in this Act that can be
demonstrated by published or | ||||||
4 | current research not to be an exotic weed as
defined in Section | ||||||
5 | 2.

8 | Sec. 4. Control of Exotic Weeds. | ||||||
9 | (a) It shall be unlawful for any
person, corporation, | ||||||
10 | political subdivision, agency or department of the
State to | ||||||
11 | buy, sell, offer for sale, distribute or plant seeds, plants or
| ||||||
12 | plant parts of exotic weeds without a permit issued by the | ||||||
13 | Department of
Natural Resources. Such permits shall be issued | ||||||
14 | only : | ||||||
15 | (1) for
experiments into
controlling and eradicating | ||||||
16 | exotic weeds ; or | ||||||
17 | (2) for research to demonstrate
that a variety of a | ||||||
18 | species listed in this Act is not an exotic weed as
defined | ||||||
19 | in Section 2 ; or .
| ||||||
20 | (3) for the use of exotic olive (Elaeagnus umbellata, | ||||||
21 | Elaeagnus pungens, Elaeagnus angustifolia) berries in the | ||||||
22 | manufacture of value added products, not to include the | ||||||
23 | resale of whole berries or seeds. The exotic berry permit | ||||||
24 | holder must register annually with the Department of | ||||||
25 | Natural Resources and be able to demonstrate to the |

1 | Department that seeds remaining post-manufacture are | ||||||
2 | sterile or otherwise unviable. | ||||||
3 | (b) The commercial propagation of exotic weeds for sale | ||||||
4 | outside
Illinois, certified under the Insect Pest and Plant | ||||||
5 | Disease Act, is
exempted from the provisions of this Section.

6 | (c) The Department of Natural Resources may adopt rules for | ||||||
7 | the administration of this Section. | ||||||
