AMENDMENT TO SENATE BILL 624

2    AMENDMENT NO. ______. Amend Senate Bill 624 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 9-131 as follows:
 
6    (605 ILCS 5/9-131)
7    Sec. 9-131. Installation of fiber-optic network conduit.
8    (a) For purposes of this Section:
9    "Fiber-optic network conduit" means a pipe or duct used to
10enclose fiber-optic cable facilities buried alongside the
11roadway or surface mounted on bridges, overpasses, and other
12facilities where below ground placement is impossible or
13impractical.
14    (b) In order to ensure affordable high-speed, world-class
15core information and communication networks are available
16throughout Illinois, the Illinois Department of Transportation

1and the Department of Central Management Services shall
2collaborate to install fiber-optic network conduit where it
3does not already exist in every new State-funded construction
4project that opens, bores, or trenches alongside a State-owned
5infrastructure, including, but not limited to, roadways and
6bridges. The Department of Central Management Services or the
7Department of Transportation may permit a third party to manage
8the fiber and conduit leasing. A unit of local government with
9a population of more than 1,000,000 inhabitants shall be
10notified of fiber-optic network conduit installations made
11under this Section and shall have the right to install
12fiber-optic network conduit during State-funded construction
13projects. The Department of Central Management Services and the
14Department of Transportation shall take reasonable steps to
15ensure market-based, non-discriminatory pricing. Public
16bidding notices for such projects must describe the need for
17fiber-optic conduit or cable. The Department of Transportation
18shall report annually to the Governor and the General Assembly
19on the progress and any associated costs incurred by this
20Section. This Section does not prohibit the State from
21purchasing or installing fiber-optic cable within the
22fiber-optic network conduit.
