3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Illinois Lottery Law is amended by changing |
5 | | Section 21.5 as follows: |
6 | | (20 ILCS 1605/21.5)

7 | | Sec. 21.5. Carolyn Adams Ticket For The Cure. |
8 | | (a) The Department shall offer a special instant |
9 | | scratch-off game with the title of "Carolyn Adams Ticket For |
10 | | The Cure". The game shall commence on January 1, 2006 or as |
11 | | soon thereafter, in the discretion of the Director, as is |
12 | | reasonably practical, and shall be discontinued on December 31, |
13 | | 2026 2016 . The operation of the game shall be governed by this |
14 | | Act and any rules adopted by the Department. The Department |
15 | | must consult with the Carolyn Adams Ticket For The Cure Board, |
16 | | which is established under Section 2310-347 of the Department |

2 | | Administrative Code of Illinois, regarding the design and |
3 | | promotion of the game. If any provision of this Section is |
4 | | inconsistent with any other provision of this Act, then this |
5 | | Section governs. |
6 | | (b) The Carolyn Adams Ticket For The Cure Grant Fund is |
7 | | created as a special fund in the State treasury. The net |
8 | | revenue from the Carolyn Adams Ticket For The Cure special |
9 | | instant scratch-off game shall be deposited into the Fund for |
10 | | appropriation by the General Assembly solely to the Department |
11 | | of Public Health for the purpose of making grants to public or |
12 | | private entities in Illinois for the purpose of funding breast |
13 | | cancer research, and supportive services for breast cancer |
14 | | survivors and those impacted by breast cancer and breast cancer |
15 | | education. In awarding grants, the Department of Public Health |
16 | | shall consider criteria that includes, but is not limited to, |
17 | | projects and initiatives that address disparities in incidence |
18 | | and mortality rates of breast cancer, based on data from the |
19 | | Illinois Cancer Registry, and populations facing barriers to |
20 | | care. The Department of Public Health shall, before grants are |
21 | | awarded, provide copies of all grant applications to the |
22 | | Carolyn Adams Ticket For The Cure Board, receive and review the |
23 | | Board's recommendations and comments, and consult with the |
24 | | Board regarding the grants. For purposes of this Section, the |
25 | | term "research" includes, without limitation, expenditures to |
26 | | develop and advance the understanding, techniques, and |

1 | | modalities effective in the detection, prevention, screening, |
2 | | and treatment of breast cancer and may include clinical trials. |
3 | | The grant funds may not be used for institutional, |
4 | | organizational, or community-based overhead costs, indirect |
5 | | costs, or levies. |
6 | | Moneys received for the purposes of this Section, |
7 | | including, without limitation, net revenue from the special |
8 | | instant scratch-off game and gifts, grants, and awards from any |
9 | | public or private entity, must be deposited into the Fund. Any |
10 | | interest earned on moneys in the Fund must be deposited into |
11 | | the Fund. |
12 | | For purposes of this subsection, "net revenue" means the |
13 | | total amount for which tickets have been sold less the sum of |
14 | | the amount paid out in prizes and the actual administrative |
15 | | expenses of the Department solely related to the Ticket For The |
16 | | Cure game. |
17 | | (c) During the time that tickets are sold for the Carolyn |
18 | | Adams Ticket For The Cure game, the Department shall not |
19 | | unreasonably diminish the efforts devoted to marketing any |
20 | | other instant scratch-off lottery game. |
21 | | (d) The Department may adopt any rules necessary to |
22 | | implement and administer the provisions of this Section.

2 | | amended by changing Section 2310-347 as follows: |
3 | | (20 ILCS 2310/2310-347)

4 | | Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board. |
5 | | (a) The Carolyn Adams Ticket For The Cure Board is created |
6 | | as an advisory board within the Department. Until 30 days after |
7 | | the effective date of this amendatory Act of the 97th General |
8 | | Assembly, the Board may consist of 10 members as follows: 2 |
9 | | members appointed by the President of the Senate; 2 members |
10 | | appointed by the Minority Leader of the Senate; 2 members |
11 | | appointed by the Speaker of the House of Representatives; 2 |
12 | | members appointed by the Minority Leader of the House of |
13 | | Representatives; and 2 members appointed by the Governor with |
14 | | the advice and consent of the Senate, one of whom shall be |
15 | | designated as chair of the Board at the time of appointment. |
16 | | (a-5) Notwithstanding any provision of this Article to the |
17 | | contrary, the term of office of each current Board member ends |
18 | | 30 days after the effective date of this amendatory Act of the |
19 | | 97th General Assembly or when his or her successor is appointed |
20 | | and qualified, whichever occurs sooner. No later than 30 days |
21 | | after the effective date of this amendatory Act of the 97th |
22 | | General Assembly, the Board shall consist of 10 newly appointed |
23 | | members. Four of the Board members shall be members of the |
24 | | General Assembly and appointed as follows: one member appointed |
25 | | by the President of the Senate; one member appointed by the |

1 | | Minority Leader of the Senate; one member appointed by the |
2 | | Speaker of the House of Representatives; and one member |
3 | | appointed by the Minority Leader of the House of |
4 | | Representatives. |
5 | | Six of the Board members shall be appointed by the Director |
6 | | of the Department of Public Health, who shall designate one of |
7 | | these appointed members as chair of the Board at the time of |
8 | | his or her appointment. These 6 members appointed by the |
9 | | Director shall reflect the population with regard to ethnic, |
10 | | racial, and geographical composition and shall include the |
11 | | following individuals: one breast cancer survivor; one |
12 | | physician specializing in breast cancer or related medical |
13 | | issues; one breast cancer researcher; one representative from a |
14 | | breast cancer organization; one individual who operates a |
15 | | patient navigation program at a major hospital or health |
16 | | system; and one breast cancer professional that may include, |
17 | | but not be limited to, a genetics counselor, a social worker, a |
18 | | detain, an occupational therapist, or a nurse. |
19 | | A Board member whose term has expired may continue to serve |
20 | | until a successor is appointed. A Board member who is not a |
21 | | member of the General Assembly may serve 2 consecutive 3-year |
22 | | terms and shall not be reappointed for 3 years after the |
23 | | completion of those consecutive terms. |
24 | | (b) Board members shall serve without compensation but may |
25 | | be reimbursed for their reasonable travel expenses incurred in |
26 | | performing their duties from funds available for that purpose. |

1 | | The Department shall provide staff and administrative support |
2 | | services to the Board. |
3 | | (c) The Board may advise: |
4 | | (i) the Department of Revenue in designing and |
5 | | promoting the Carolyn Adams Ticket For The Cure special |
6 | | instant scratch-off lottery game; |
7 | | (ii) the Department in reviewing grant applications; |
8 | | and |
9 | | (iii) the Director on the final award of grants from |
10 | | amounts appropriated from the Carolyn Adams Ticket For The |
11 | | Cure Grant Fund, to public or private entities in Illinois |
12 | | that reflect the population with regard to ethnic, racial, |
13 | | and geographical composition for the purpose of funding |
14 | | breast cancer research and supportive services for breast |
15 | | cancer survivors and those impacted by breast cancer and |
16 | | breast cancer education. In awarding grants, the |
17 | | Department shall consider criteria that includes, but is |
18 | | not limited to, projects and initiatives that address |
19 | | disparities in incidence and mortality rates of breast |
20 | | cancer, based on data from the Illinois Cancer Registry, |
21 | | and populations facing barriers to care in accordance with |
22 | | Section 21.5 of the Illinois Lottery Law. |
23 | | (c-5) The Department shall submit a report to the Governor |
24 | | and the General Assembly by December 31 of each year. The |
25 | | report shall provide a summary of the Carolyn Adams Ticket for |
26 | | the Cure lottery ticket sales, grants awarded, and the |
