1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 21.5 as follows:
 
6    (20 ILCS 1605/21.5)
7    Sec. 21.5. Carolyn Adams Ticket For The Cure.
8    (a) The Department shall offer a special instant
9scratch-off game with the title of "Carolyn Adams Ticket For
10The Cure". The game shall commence on January 1, 2006 or as
11soon thereafter, in the discretion of the Director, as is
12reasonably practical, and shall be discontinued on December 31,
132026 2016. The operation of the game shall be governed by this
14Act and any rules adopted by the Department. The Department
15must consult with the Carolyn Adams Ticket For The Cure Board,
16which is established under Section 2310-347 of the Department
17of Public Health Powers and Duties Law of the Civil
18Administrative Code of Illinois, regarding the design and
19promotion of the game. If any provision of this Section is
20inconsistent with any other provision of this Act, then this
21Section governs.
22    (b) The Carolyn Adams Ticket For The Cure Grant Fund is
23created as a special fund in the State treasury. The net

1revenue from the Carolyn Adams Ticket For The Cure special
2instant scratch-off game shall be deposited into the Fund for
3appropriation by the General Assembly solely to the Department
4of Public Health for the purpose of making grants to public or
5private entities in Illinois for the purpose of funding breast
6cancer research, and supportive services for breast cancer
7survivors and those impacted by breast cancer and breast cancer
8education. In awarding grants, the Department of Public Health
9shall consider criteria that includes, but is not limited to,
10projects and initiatives that address disparities in incidence
11and mortality rates of breast cancer, based on data from the
12Illinois Cancer Registry, and populations facing barriers to
13care. The Department of Public Health shall, before grants are
14awarded, provide copies of all grant applications to the
15Carolyn Adams Ticket For The Cure Board, receive and review the
16Board's recommendations and comments, and consult with the
17Board regarding the grants. For purposes of this Section, the
18term "research" includes, without limitation, expenditures to
19develop and advance the understanding, techniques, and
20modalities effective in the detection, prevention, screening,
21and treatment of breast cancer and may include clinical trials.
22The grant funds may not be used for institutional,
23organizational, or community-based overhead costs, indirect
24costs, or levies.
25    Moneys received for the purposes of this Section,
26including, without limitation, net revenue from the special

1instant scratch-off game and gifts, grants, and awards from any
2public or private entity, must be deposited into the Fund. Any
3interest earned on moneys in the Fund must be deposited into
4the Fund.
5    For purposes of this subsection, "net revenue" means the
6total amount for which tickets have been sold less the sum of
7the amount paid out in prizes and the actual administrative
8expenses of the Department solely related to the Ticket For The
9Cure game.
10    (c) During the time that tickets are sold for the Carolyn
11Adams Ticket For The Cure game, the Department shall not
12unreasonably diminish the efforts devoted to marketing any
13other instant scratch-off lottery game.
14    (d) The Department may adopt any rules necessary to
15implement and administer the provisions of this Section.

18    Section 10. The Department of Public Health Powers and
19Duties Law of the Civil Administrative Code of Illinois is
20amended by changing Section 2310-347 as follows:

22    Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board.
23    (a) The Carolyn Adams Ticket For The Cure Board is created
24as an advisory board within the Department. Until 30 days after

1the effective date of this amendatory Act of the 97th General
2Assembly, the Board may consist of 10 members as follows: 2
3members appointed by the President of the Senate; 2 members
4appointed by the Minority Leader of the Senate; 2 members
5appointed by the Speaker of the House of Representatives; 2
6members appointed by the Minority Leader of the House of
7Representatives; and 2 members appointed by the Governor with
8the advice and consent of the Senate, one of whom shall be
9designated as chair of the Board at the time of appointment.
10    (a-5) Notwithstanding any provision of this Article to the
11contrary, the term of office of each current Board member ends
1230 days after the effective date of this amendatory Act of the
1397th General Assembly or when his or her successor is appointed
14and qualified, whichever occurs sooner. No later than 30 days
15after the effective date of this amendatory Act of the 97th
16General Assembly, the Board shall consist of 10 newly appointed
17members. Four of the Board members shall be members of the
18General Assembly and appointed as follows: one member appointed
19by the President of the Senate; one member appointed by the
20Minority Leader of the Senate; one member appointed by the
21Speaker of the House of Representatives; and one member
22appointed by the Minority Leader of the House of
23Representatives.
24    Six of the Board members shall be appointed by the Director
25of the Department of Public Health, who shall designate one of
26these appointed members as chair of the Board at the time of

1his or her appointment. These 6 members appointed by the
2Director shall reflect the population with regard to ethnic,
3racial, and geographical composition and shall include the
4following individuals: one breast cancer survivor; one
5physician specializing in breast cancer or related medical
6issues; one breast cancer researcher; one representative from a
7breast cancer organization; one individual who operates a
8patient navigation program at a major hospital or health
9system; and one breast cancer professional that may include,
10but not be limited to, a genetics counselor, a social worker, a
11detain, an occupational therapist, or a nurse.
12    A Board member whose term has expired may continue to serve
13until a successor is appointed. A Board member who is not a
14member of the General Assembly may serve 2 consecutive 3-year
15terms and shall not be reappointed for 3 years after the
16completion of those consecutive terms.
17    (b) Board members shall serve without compensation but may
18be reimbursed for their reasonable travel expenses incurred in
19performing their duties from funds available for that purpose.
20The Department shall provide staff and administrative support
21services to the Board.
22    (c) The Board may advise:
23        (i) the Department of Revenue in designing and
24    promoting the Carolyn Adams Ticket For The Cure special
25    instant scratch-off lottery game;
26        (ii) the Department in reviewing grant applications;

1    and
2        (iii) the Director on the final award of grants from
3    amounts appropriated from the Carolyn Adams Ticket For The
4    Cure Grant Fund, to public or private entities in Illinois
5    that reflect the population with regard to ethnic, racial,
6    and geographical composition for the purpose of funding
7    breast cancer research and supportive services for breast
8    cancer survivors and those impacted by breast cancer and
9    breast cancer education. In awarding grants, the
10    Department shall consider criteria that includes, but is
11    not limited to, projects and initiatives that address
12    disparities in incidence and mortality rates of breast
13    cancer, based on data from the Illinois Cancer Registry,
14    and populations facing barriers to care in accordance with
15    Section 21.5 of the Illinois Lottery Law.
16    (c-5) The Department shall submit a report to the Governor
17and the General Assembly by December 31 of each year. The
18report shall provide a summary of the Carolyn Adams Ticket for
19the Cure lottery ticket sales, grants awarded, and the
20accomplishments of the grantees.
21    (d) The Board is discontinued on June 30, 2027 2017.

23    Section 99. Effective date. This Act takes effect upon
