AMENDMENT TO SENATE BILL 373




2    AMENDMENT NO. ______. Amend Senate Bill 373 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Township Code is amended  by adding Section 
5200-14c as follows:
 
6    (60 ILCS 1/200-14c  new)
7    Sec. 200-14c. Notification of sale of or changes to private 
8or semi-private water systems.
9    (a) For purposes of this Section, "private water system" 
10and "semi-private water system" shall have the meanings 
11ascribed to them in subsection (a) of Section 9 of the Illinois 
12Groundwater Protection Act.
13    (b) A township that provides fire protection services shall 
14receive notice of the sale of a private water system or 
15semi-private water system from the individuals or entities 
16selling and purchasing the water system.  The notice to the

1township shall include the status and capacity of the water 
2system and the ability of the water system to be used for fire 
3protection.
4    (c) A township that provides fire protection services shall 
5also receive notice from the owner of a private water system or 
6semi-private water system if there are any changes to the water 
7system that would affect fire protection services to areas 
8served by the water system.
 
9    Section 10. The Illinois Municipal Code is amended  by 
10adding Section 11-6-8 as follows:
 
11    (65 ILCS 5/11-6-8 new)
12    Sec. 11-6-8. Notification of sale of or changes to private 
13or semi-private water systems.
14    (a) For purposes of this Section, "private water system" 
15and "semi-private water system" shall have the meanings 
16ascribed to them in subsection (a) of Section 9 of the Illinois 
17Groundwater Protection Act.
18    (b) A municipality that provides and operates fire stations 
19or otherwise provides firefighting services shall receive 
20notice of the sale of a private water system or semi-private 
21water system from the individuals or entities selling and 
22purchasing the water system.  The notice to the municipality 
23shall include the status and capacity of the water system and 
24the ability of the water system to be used for fire protection.

1    (c) A municipality that provides and operates fire stations

7    Section 15. The Fire Protection District Act is amended  by 
8adding Section 27 as follows:
 
9    (70 ILCS 705/27 new)
10    Sec. 27. Notification of sale of or changes to private or 
11semi-private water systems.
12    (a) For purposes of this Section, "private water system" 
13and "semi-private water system" shall have the meanings 
14ascribed to them in subsection (a) of Section 9 of the Illinois 
15Groundwater Protection Act.
16    (b) A fire protection district shall receive notice of the 
17sale of a private water system or semi-private water system 
18from the individuals or entities selling and purchasing the 
19water system.  The notice to the fire protection district shall 
20include the status and capacity of the water system and the 
21ability of the water system to be used for fire protection.
22    (c) A fire protection district shall also receive notice 
23from the owner of a private water system or semi-private water 
24system if there are any changes to the water system that would

1affect fire protection services to areas served by the water 
2system.
 

3    Section 99. Effective date. This Act takes effect upon 
4becoming law.".
