2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Children's Privacy Protection and Parental |
5 | | Empowerment Act is amended by changing Section 15 as follows:
|

7 | | (Section scheduled to be repealed on January 1, 2015)

8 | | Sec. 15. Information brokers.
|
9 | | (a) For the
the purpose of this Act, the consent of a |
10 | | parent to the sale or
purchase of
information concerning a |
11 | | child is presumed unless the parent withdraws consent
under
|
12 | | this Section. |
13 | | A person who brokers or facilitates the sale of personal |
14 | | information
concerning
children must, upon written request |
15 | | from a parent that specifically identifies
the child,
provide |
16 | | to the parent within 20 days of the written request procedures |
17 | | that the
parent
must follow in order to withdraw consent to use |
18 | | personal information relating
to that
child. The person who |
19 | | brokers or facilitates the sale of personal information
must

20 | | discontinue disclosing a child's personal information within |
21 | | 20 days after the
parent has
completed the procedures to |
22 | | withdraw consent to use personal information
relating to that
|
23 | | child.
