Amends the Emergency Telephone System Act. Provides that a public safety agency, public agency, qualified governmental entity, or Emergency Telephone System Board may seek reimbursement from the Illinois Commerce Commission (ICC) for installation of an additional trunk line due to an employee or designee of a public safety agency being required to physically transfer 9-1-1 calls at the private branch exchange due to a failure by a system provider's trunk line 3 or more times within a 12-month period. Provides that repair and monthly trunk line fees will also be reimbursed by the ICC. Provides that the ICC shall not provide reimbursement for more than one additional trunk line and related repairs and fees. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Emergency Telephone System Act is amended by |
5 | | adding Section 8.5 as follows: |
6 | | (50 ILCS 750/8.5 new) |
7 | | Sec. 8.5. Reimbursement for additional trunk line |
8 | | installation, repairs, and fees. |
9 | | (a) A public safety agency, public agency, qualified |
10 | | governmental entity, or Emergency Telephone System Board may |
11 | | seek reimbursement from the Commission for installation of an |
12 | | additional trunk line to a public safety agency's 9-1-1 system |
13 | | by submitting one or more affidavits to the Commission stating |
14 | | that: |
15 | | (1) an employee or designee of a public safety agency |
16 | | was required to physically transfer 9-1-1 calls at the |
17 | | private branch exchange due to a failure by a system |
18 | | provider's trunk line 3 or more times within a 12-month |
19 | | period; |
20 | | (2) an additional trunk line has been installed |
21 | | following the occurrences in paragraph (1); and |
22 | | (3) a receipt evidencing the installation of the |
23 | | additional trunk line installation is attached to the |

1 | | affidavit. |
2 | | (b) If the Commission receives an affidavit or affidavits |
3 | | meeting the requirements of subsection (a), the Commission |
4 | | shall reimburse the public safety agency, public agency, |
5 | | qualified governmental entity, or Emergency Telephone System |
6 | | Board for the installation of the additional trunk line to the |
7 | | public safety agency's 9-1-1 system within 90 days of receipt. |
8 | | (c) After being reimbursed by the Commission for the |
9 | | installation of an additional trunk line under subsection (b), |
10 | | a public safety agency, public agency, qualified governmental |
11 | | entity, or Emergency Telephone System Board may request |
12 | | reimbursement for any repairs and monthly trunk line fees for |
13 | | the additional trunk line by submitting one or more affidavits, |
14 | | but no more than 4 requests may be submitted in any calendar |
15 | | year, requesting reimbursement of repairs and monthly trunk |
16 | | line fees. Invoices for any repairs and monthly trunk line fees |
17 | | must be attached to any affidavit submitted. The Commission |
18 | | must submit reimbursement for the repairs and monthly trunk |
19 | | line fees within 90 days of receipt. |
20 | | (d) The Commission shall not reimburse a public safety |
21 | | agency, public agency, qualified governmental entity, or |
22 | | Emergency Telephone System Board for more than one additional |
23 | | trunk line and its related repairs and fees.

24 | | Section 99. Effective date. This Act takes effect upon |
25 | | becoming law.
