1 | HOUSE RESOLUTION

2 | WHEREAS, The members of the Illinois General Assembly | ||||||
3 | passed Public Act 98-506 to ensure
that anyone driving a car is | ||||||
4 | careful, responsive, and alert behind the wheel; and
| ||||||
5 | WHEREAS, Illinois joined a dozen other states with similar | ||||||
6 | restrictions and will allow drivers to
operate under a uniform | ||||||
7 | ban; and
| ||||||
8 | WHEREAS, Public Act 98-506 provided that Illinois drivers | ||||||
9 | may not operate a motor vehicle on
a roadway while using an | ||||||
10 | electronic communication device; and
| ||||||
11 | WHEREAS, A person who violates Public Act 98-508 will be | ||||||
12 | fined a maximum of $75 for a first
offense, $100 for a second | ||||||
13 | offense, $125 for a third offense, and $150 for a fourth or | ||||||
14 | subsequent
offense; and
| ||||||
15 | WHEREAS, A first offense for driving while using an | ||||||
16 | electronic communication device will not
be considered a moving | ||||||
17 | violation; subsequent offences will be considered moving | ||||||
18 | violations
and will be recorded on one's driving record; and
| ||||||
19 | WHEREAS, The new handheld cell phone ban is a primary stop | ||||||
20 | offense, which means that a
driver can be stopped without |

1 | committing any other violation; and | ||||||
2 | WHEREAS, Public Act 98-506 was an initiative based on the | ||||||
3 | National Transportation Safety Board's recommendation for a
| ||||||
4 | nationwide ban on the use of cell phones while driving; and
| ||||||
5 | WHEREAS, Other states that have implemented the bans have | ||||||
6 | done research, noting that there may
be little difference | ||||||
7 | between drivers who use hand-held cell phones and who use | ||||||
8 | hands-free
devices; and
| ||||||
9 | WHEREAS, It is important for the Illinois General Assembly | ||||||
10 | to evaluate the impact of
legislation to insure the safety of | ||||||
11 | all Illinois drivers; therefore, be it
| ||||||
12 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | ||||||
13 | NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we | ||||||
14 | urge the Illinois State Police
and the Illinois Department of | ||||||
15 | Transportation to study the impact of Public Act 98-506 and
to | ||||||
16 | deliver a report to the members of the Illinois House of | ||||||
17 | Representatives by January 1, 2016; and be it further
| ||||||
18 | RESOLVED, That suitable copies of this resolution be | ||||||
19 | presented to the Secretary of State Police and the Secretary of | ||||||
20 | Transportation.
