Synopsis As Introduced
Creates the Small Wireless Facilities Deployment Act. Provides that an authority, defined as a city, village, incorporated town, township, or county and each department or agency thereof, may not prohibit or regulate the collocation of small wireless facilities or small facility networks. Provides that small wireless facilities and small facility networks shall be a permitted use in all authority zoning districts. In provisions concerning building, electrical, and public use permits, provides that an authority may: require a person to obtain permits for the collocation of small wireless facilities and small facility networks to the same extent permits are required for other construction, activity, and uses; not require applicants to provide information not required of other applicants; not require an application fee greater than the amount charged to other telecommunications providers. Sets out fee exemptions and fee limits related to collocating small wireless facilities and small facility networks.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause. Creates the Small Wireless Facilities Deployment Act. Defines terms, including defining "authority" as a city, village, incorporated town, township, county, unit of local government, or special district that has jurisdiction and control for use of the public rights-of-way as provided by the Illinois Highway Code for placements within the public rights-of-way or has zoning or land use control for placements not within the public rights-of-way. Provides that an authority may not prohibit, regulate, or charge for the collocation of small wireless facilities or small wireless facility networks except as provided in the Act. Specifies circumstances under which small wireless facilities and small wireless facility networks shall be classified as special or conditional uses and circumstances under which small wireless facilities and small wireless facility networks may be classified as special or conditional uses. In a provision concerning permits for the collocation of small wireless facilities and small wireless facility networks, provides rules for: assessing application fees; conditioning approval on performance of services unrelated to the permit; information required by the application; processing time; denial of an application; duration of a permit; anti-discrimination policy; and other matters. Provides rules for collocating small wireless facilities and small wireless facility networks on authority utility poles located within the public rights-of way. Provides that an authority shall authorize the collocation of small wireless facilities and small wireless facilities networks on authority structures not located within the public rights-of-way as it would for other commercial projects or uses and may authorize such collocation if an authority has not previously permitted such access. Limits home rule powers.
