Synopsis As Introduced
Amends the Public Utilities Act. Requires the Illinois Commerce Commission to update its response presented in the report titled "Potential Nuclear Power Plant Closings in Illinois". Also requires the Commission to update, in conjunction with the Illinois Power Agency, the Illinois Environmental Protection Agency, and the Department of Commerce and Economic Opportunity, the report's findings regarding potential market-based solutions that will ensure the premature closure of these nuclear power plants does not occur and that the dire consequence to the economy, jobs, and the environment are averted. Provides that the provision is repealed on June 30, 2017. Effective immediately.

Replaces everything after the enacting clause. Contains legislative findings concerning low carbon portfolio standards. Amends the Illinois Power Agency Act. Defines "low carbon energy credit" and "low carbon energy resources." Provides that beginning with the partial planning year commencing on January 1, 2016, procurement plans shall include cost-effective low carbon energy credits from low carbon energy resources in an amount equal to 70% of each electric utility's annual retail sales of electricity to retail customers in the State during the planning year immediately prior to the development of the procurement plan. the initial procurement event, the Agency and Commission shall initiate additional procurement processes, as necessary, to replace any low carbon energy credits that were not delivered due to a supplier default or in the event that additional low carbon energy credits must be procured for a time period commencing after May 31, 2021. Amends the Public Utilities Act. Provides that the electric utility shall be entitled to recover through tariffed charges all of the costs associated with the purchase of low carbon energy credits from low carbon energy resources to meet the of the Illinois Power Agency Act. Provides that the electric utility shall be entitled to recover all costs associated with the purchase of low carbon energy credits from low carbon energy resources through an automatic adjustment clause tariff applicable to all of the utility's retail customers that allows the electric utility to adjust its tariffed charges on a quarterly basis for changes in its costs incurred to purchase such resources and credits, if any, without the need to file a general delivery services rate case. Provides that every electric utility and alternative retail electric supplier shall provide after May 31, 2016, a pie-chart that graphically depicts the quantity of low carbon energy credits from low carbon energy resources procured under the Illinois Power Agency Act. Makes other changes. Effective immediately.
