Synopsis As Introduced
Amends the Alcoholism and other Drug Abuse and Dependency Act. Provides that an addict may elect treatment under supervision of a designated program if the offense is possession of a controlled substance or possession of 500 grams or less of cannabis. Amends the Criminal Identification Act. Expands offenses subject to sealing and expungement. Amends the Criminal Code of 2012. Changes the penalties for various offenses. Amends the Cannabis Control Act. Provides that possession of 57 grams or less of cannabis is a civil violation with a $25 fine. Provides that the manufacture, delivery, or possession with intent to deliver, or manufacture of 57 grams or less of any substance containing cannabis is a civil violation and subject to a $25 fine. Provides that possessing, growing, producing, or processing not more than 5 cannabis sativa plants, provided that the growing is not conducted openly or publicly and is not provided for sale or consideration, shall constitute a civil violation and shall be subject to a fine of $25. Amends the Drug Paraphernalia Control Act. Provides that if a person has possession of 57 grams or less of cannabis, the penalty for possession of any drug paraphernalia seized during the violation for that offense shall be a civil violation punishable by a fine of $25. Amends the Unified Code of Corrections. Eliminates minimum sentences for all classes of offenses. Amends various Acts concerning other penalties. Provides that the amendatory Act applies to offenses committed before its effective date, and to offenses committed on or after its effective date. Provides that an offender who currently is serving sentence for a felony which is reduced to a lesser felony or to a misdemeanor by the amendatory Act may petition the court for resentencing to a lesser sentence and be given credit for time served.
