Synopsis As Introduced
Amends the Illinois Food, Drug and Cosmetic Act. Provides that any label of fresh, frozen, or processed fish or shellfish, wild or farm raised, offered for sale at wholesale or retail shall clearly identify (1) the species of fish or shellfish by its common name, (2) whether the fish or shellfish was farm raised or wild caught, and (3) whether the fish or shellfish was caught domestically or imported. Provides that a retail food facility that sells or offers for sale any fresh, frozen, or processed fish or shellfish, wild or farm raised, may not knowingly misidentify or misbrand (1) the country of origin of the fish or shellfish or (2) whether the fish or shellfish was farm raised or wild caught. Sets forth provisions concerning misbranding and the presumption of knowledge.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with the following changes: removes processed fish from the provisions of the amendatory Act. Defines "market name" instead of "common name" to mean the market name for any seafood species identified in the Seafood List issued by the federal Food and Drug Administration. Requires any label of fresh or frozen fish or shellfish to include the country of origin of the fish or shellfish. Defines "farm raised" and "wild caught" fish and shellfish. Adds a penalty provision. Provides that the provisions of the amendatory Act shall become operative 18 months after the effective date.

 Balanced Budget Note, House Committee Amendment No. 1 (Office of Management and Budget)
 This bill will have a significant fiscal impact on the State of Illinois budget. The Department of Public Health has the ability to levy fines for non compliance with the bill, but the upfront costs of developing rules, procedures, and initial testing before any fines are collected will require significant resources that the Department and State of Illinois do not have. The Department of Public Health and the Governor's Office of Management and Budget estimate that it will cost approximately $150 per sample of fish tested but current estimates of the amount of samples that will need to be genetically tested are not available at this time.
