SYNOPSIS AS INTRODUCED:

    Amends the Clinical Psychologist Licensing Act, Clinical Social Work and Social Work Practice Act, Marriage and Family Therapy Licensing Act, and Professional Counselor and Clinical Professional Counselor Licensing and Practice Act. In each Act, defines "sexual orientation change efforts" and provides that a professional licensed under the Act shall not engage in sexual orientation change efforts with a patient younger than 18 years of age. Further provides in each Act that any sexual orientation change efforts attempted on a patient younger than 18 years of age shall be grounds for discipline under the Act.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Clinical Psychologist Licensing Act is
5amended by adding Section 14.5 as follows:
 
6    (225 ILCS 15/14.5 new)
7    Sec. 14.5. Sexual orientation change efforts. Under no
8circumstances shall a clinical psychologist engage in sexual
9orientation change efforts with a patient younger than 18 years
10of age. Any sexual orientation change efforts attempted on a
11patient younger than 18 years of age by a clinical psychologist
12shall be considered unprofessional conduct and shall be grounds
13for discipline under this Act. For the purposes of this
14Section, "sexual orientation change efforts" means the
15practice of seeking to change a person's sexual orientation,
16including, but not limited to, efforts to change behaviors,
17gender identity, or gender expressions or to eliminate or
18reduce sexual or romantic attractions or feelings towards
19persons of the same gender. "Sexual orientation change efforts"
20does not include counseling for a person seeking to transition
21from one gender to another, counseling that provides
22acceptance, support, and understanding of a person without
23seeking to change sexual orientation, or counseling that

1facilitates a person's coping, social support, and identity
2exploration and development, including sexual
3orientation-neutral interventions to prevent or address
4unlawful conduct or unsafe sexual practices, without seeking to
5change sexual orientation.
 
6    Section 10. The Clinical Social Work and Social Work
7Practice Act is amended by adding Section 18.5 as follows:
 
8    (225 ILCS 20/18.5 new)
9    Sec. 18.5. Sexual orientation change efforts. Under no
10circumstances shall a licensed clinical social worker or
11licensed social worker engage in sexual orientation change
12efforts with a patient younger than 18 years of age. Any sexual
13orientation change efforts attempted on a patient younger than
1418 years of age by a licensed clinical social worker or
15licensed social worker shall be considered unprofessional
16conduct and shall be grounds for discipline under this Act. For
17the purposes of this subsection, "sexual orientation change
18efforts" means the practice of seeking to change a person's
19sexual orientation, including, but not limited to, efforts to
20change behaviors, gender identity, or gender expressions or to
21eliminate or reduce sexual or romantic attractions or feelings
22towards persons of the same gender. "Sexual orientation change
23efforts" does not include counseling for a person seeking to
24transition from one gender to another, counseling that provides

9is amended by adding Section 84 as follows:

11    Sec. 84. Sexual orientation change efforts. Under no
12circumstances shall a marriage and family therapist engage in
13sexual orientation change efforts with a patient younger than
1418 years of age. Any sexual orientation change efforts
15attempted on a patient younger than 18 years of age by a
16marriage and family therapist shall be considered
17unprofessional conduct and shall be grounds for discipline
18under this Act. For the purposes of this subsection, "sexual
19orientation change efforts" means the practice of seeking to
20change a person's sexual orientation, including, but not
21limited to, efforts to change behaviors, gender identity, or
22gender expressions or to eliminate or reduce sexual or romantic
23attractions or feelings towards persons of the same gender.
24"Sexual orientation change efforts" does not include

3understanding of a person without seeking to change sexual

8seeking to change sexual orientation.
 
9    Section 20. The Professional Counselor and Clinical
10Professional Counselor Licensing and Practice Act is amended
11adding Section 79 as follows:

13    Sec. 79. Sexual orientation change efforts. Under no
14circumstances shall a professional counselor or clinical
15professional counselor engage in sexual orientation change
16efforts with a patient younger than 18 years of age. Any sexual
17orientation change efforts attempted on a patient younger than
