Amends the County Jail Act. Provides that a minor who is transferred to adult jurisdiction may be confined in a county jail if he or she is properly classified and supervised to comply with the federal Prison Rape Elimination Act of 2003 as nearly as possible.

1 | | AN ACT concerning criminal law.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The County Jail Act is amended by changing |
5 | | Section 11 as follows:
|
6 | | (730 ILCS 125/11) (from Ch. 75, par. 111)
|
7 | | Sec. 11.
Debtors and witnesses shall not be confined in the |
8 | | same room
with other prisoners; male and female prisoners shall |
9 | | not be kept in the
same room; minors shall be kept separate |
10 | | from those previously convicted
of a felony or other infamous |
11 | | crime; and persons charged with an offense
shall not be |
12 | | confined in the same cell as those convicted of a crime. The

13 | | confinement of those persons convicted of a misdemeanor or |
14 | | felony shall be in
accordance with a classification system |
15 | | developed and implemented by the local
jail authority.
