AMENDMENT TO SENATE BILL 3294

2    AMENDMENT NO. ______. Amend Senate Bill 3294 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by adding Section
55-1183 as follows:
 
6    (55 ILCS 5/5-1183 new)
7    Sec. 5-1183. Household goods recycling bins.
8    (a) Notwithstanding any other provision of law, any county
9may by ordinance require that all household goods recycling
10bins have a permanent, written, printed label affixed to the
11bin that is prominently displayed and includes the following:
12(1) the name, address, and contact information of the person or
13entity owning, operating, or maintaining that bin; and (2)
14whether the person or entity owning, operating, or maintaining
15the bin is a not for profit entity or a for profit entity.
16    (b) As used in this Section:

1        "Household goods recycling bin" or "bin" means a
2    container or receptacle held out to the public as a place
3    for people to discard clothes, shoes, books, and other
4    recyclable items until they are taken away for resale,
5    re-use, recycling, or redistribution by the person or
6    entity that owns, operates, or maintains the bin.
7        "Not for profit entity" means an entity that is
8    officially recognized by the United States Internal
9    Revenue Service as a tax-exempt entity described in Section
10    501(c)(3) of the Internal Revenue Code of 1986 (or any
11    successor provision of federal tax law).
 
12    Section 10. The Illinois Municipal Code is amended by
13adding Section 11-42-16 as follows:
 
14    (65 ILCS 5/11-42-16 new)
15    Sec. 11-42-16. Household goods recycling bins.
16    (a) Notwithstanding any other provision of law, any
17municipality may by ordinance require that all household goods
18recycling bins have a permanent, written, printed label affixed
19to the bin that is prominently displayed and includes the
20following: (1) the name, address, and contact information of
21the person or entity owning, operating, or maintaining that
22bin; and (2) whether the person or entity owning, operating, or
23maintaining the bin is a not for profit entity or a for profit
24entity.

1    (b) As used in this Section:

13    Section 15. The Consumer Fraud and Deceptive Business
14Practices Act is amended by adding Section 2RRR as follows:
 
15    (815 ILCS 505/2RRR new)
16    Sec. 2RRR. Household goods recycling bins.
17    (a) Notwithstanding any other provision of law, a person or
18entity owning, operating, or maintaining a household goods
19recycling bin shall have a permanent, written, printed label
20affixed to the bin that is prominently displayed and includes
21the following: (1) the name, address, and contact information
22of the person or entity owning, operating, or maintaining that
23bin; and (2) whether the person or entity owning, operating, or
24maintaining the bin is a not for profit entity or a for profit

1entity. A person or entity who violates this Section commits an
2unlawful practice within the meaning of this Act.
3    (b) As used in this Section:
4        "Household goods recycling bin" or "bin" means a

7    recyclable items until they are taken away for resale,
8    re-use, recycling, or redistribution by the person or
9    entity that owns, operates, or maintains the bin.
