AMENDMENT TO SENATE BILL 3265




2    AMENDMENT NO. ______. Amend Senate Bill 3265 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Illinois Municipal Code is amended  by 
5adding Section 11-80-24 as follows:
 
6    (65 ILCS 5/11-80-24 new)
7    Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing 
8system may operate a docking station in an area with posted 
9signs that expressly prohibit parking at any time or during 
10certain hours that is adjacent to any elementary or secondary 
11school building in any municipality.
12    For purposes of this Section:
13    "Bicycle sharing system" means a fleet of bicycles that are 
14locked into a network of docking stations that may be rented 
15from and returned to any station in the system.
16    "Docking station" includes, but is not limited to, a

1touch-screen kiosk, station map, and a docking system that 
2releases bicycles using a member key or code.
3    A home rule municipality may not regulate bicycle sharing 
4systems in a manner less restrictive than requirements of this 
5Section. This Section is a limitation under subsection (i) of 
6Section 6 of Article VII of the Illinois Constitution on the 
7concurrent exercise by home rule units of powers and functions 
8exercised by the State.".
