AMENDMENT TO SENATE BILL 2671 




2    AMENDMENT NO. ______. Amend Senate Bill 2671 as follows:


 
3on page 1, in line 5, by deleting "55.3,"; and
 
4on page 5, immediately below line 15, by inserting the 
5following:
 
6    "(d-6) No person shall cause or allow the operation of a 
7tire storage site in violation of the financial assurance rules 
8established by the Board under subsection (b) of Section 55.2 
9of this Act.  In addition to the remedies otherwise provided 
10under this Act, the State's Attorney of the county in which the 
11violation occurred, or the Attorney General, may, at the 
12request of the Agency or on his or her own motion, institute a 
13civil action for an immediate injunction, prohibitory or 
14mandatory, to restrain any violation of this subsection (d-6) 
15or to require any other action as may be necessary to abate or

1mitigate any immediate danger or threat to public health or the 
2environment at the site. Injunctions to restrain a violation of 
3this subsection (d-6)  may include, but are not limited to, the 
4required removal of all tires for which financial assurance is 
5not maintained and a prohibition against the acceptance of 
6tires in excess of the amount for which financial assurance is 
7maintained."; and
 
8on page 7, in line 14, immediately after "(d-5),", by inserting 
9"(d-6),"; and

 
10on page 7, in line 26, immediately after "(d-5),", by inserting 
11"(d-6),"; and

 
12by deleting line 12 on page 10 through line 12 on page 17.
