    Amends the Counties Code and the Illinois Municipal Code. Adds a Division addressing emergency medical services at special events. Provides that, in counties of 100,000 or more, emergency medical services shall be provided at special events at which 2,500 or more persons are projected to be in attendance in the same place at the same time. Requires additional emergency medical personnel and resources when the projected number of attendees exceeds certain thresholds. Defines terms.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Division
55-45 to Article 5 and Sections 5-45005, 5-45010, 5-45015,
65-45020, and 5-45025 as follows:

Division 5-45. Emergency Medical Services for Special Events

 
9    (55 ILCS 5/5-45005 new)
10    Sec. 5-45005. Definitions. As used in this Division:
11    "Ambulance" means an ambulance or specialized emergency
12medical service vehicle ("SEMSV") designated under items (A) or
13(B) of paragraph (3) of subsection (a) of Section 3.85 of the
14Emergency Medical Services (EMS) Systems Act that:
15        (1) is capable of transporting a patient from a special
16    event to a hospital but, upon delivering the patient,
17    immediately returns to the site of the special event; and
18        (2) is staffed by:
19            (a) at least one Emergency Medical
20        Technician-Intermediate ("EMT-I") or Emergency Medical
21        Technician-Paramedic ("EMT-P"); or
22            (b) at least two other attendants, each with an

1        equivalent or a higher level of skill than the levels
2        described in paragraph (a).
3    "Automatic external defibrillator" or "defibrillator"
4shall have the same meaning as provided in Section 10 of the
5Automatic External Defibrillator Act.
6    "First-aid station" means a fixed location at the site of a
7special event that is staffed by at least one Emergency Medical
8Technician-Basic ("EMT-B"), EMT-I, EMT-P, or a person with a
9higher level of skill who is capable of providing first
10responses services, as defined under subsection (d) of Section
113.10 of the Emergency Medical Services (EMS) Systems Act,
12within his or her scope of practice.
13    "Host organization" means:
14        (1) if a permit was obtained for a special event, the
15    person who obtained the permit; or
16        (2) if a permit was not obtained for a special event,
17    the person who sponsored the special event.
18    "Roving emergency medical technician team" means a team at
19the site of a special event that:
20        (1) consists of two or more EMT-B personnel, EMT-I
21    personnel, or EMT-P personnel; and
22        (2) has the medical supplies necessary to provide first
23    response services, as defined under subsection (d) of
24    Section 3.10 of the Emergency Medical Services (EMS)
25    Systems Act.
26    "Roving intermediate emergency medical technician team"

1means a roving emergency medical technician team that consists
2of two or more EMT-I personnel or EMT-P personnel.
3    "Significant number" means, with regard to:
4        (1) contacts by emergency medical personnel with
5    persons who attended a special event, the number of
6    contacts is 0.07% or more of the total number of persons
7    who attended the special event; and
8        (2) patients transported to a hospital, the number of
9    patients transported from the special event to the hospital
10    by ambulance or private vehicle is 15% or more of the total
11    number of contacts at the special event by emergency
12    medical personnel with persons who attended the special
13    event.
14    "Special event" means a temporary event, including,
15without limitation, a concert or sporting event, at which 2,500
16or more persons are projected to be in attendance in the same
17place at the same time. The term does not include a temporary
18event held at a location which is designed to host concerts,
19sporting events, conventions, trade shows and any other similar
20events and which has permanently established methods for
21providing first response services, as defined under subsection
22(d) of Section 3.10 of the Emergency Medical Services (EMS)
23Systems Act, or basic life support services, as defined under
24subsection (c) of Section 3.10 of the Emergency Medical
25Services (EMS) Systems Act, at the location.

1    (55 ILCS 5/5-45010 new)
2    Sec. 5-45010. First-aid stations; emergency medical
3technicians.
4    (a) In a county whose population is 100,000 or more, if a
5special event at which 2,500 or more persons but less than
610,000 persons are projected to be in attendance in the same
7place at the same time, the host organization shall provide at
8least one first-aid station at the site of the special event
9if:
10        (1) the special event is a concert; or
11        (2) three or more of the following factors apply to the
12    special event:
13            (A) The special event involves a high-risk
14        activity, including, without limitation, sports or
15        racing.
16            (B) The special event poses environmental hazards
17        to persons attending the special event or is held
18        during a period of extreme heat or cold.
19            (C) The average age of the persons attending the
20        special event is less than 25 years of age or more than
21        50 years of age.
22            (D) A large number of the persons attending the
23        special event have acute or chronic illnesses.
24            (E) Alcohol is sold at the special event or, if the
25        special event has been held before, there is a history
26        of alcohol or drug use by the persons who attended the

1        special event in the past.
2            (F) The density of the number of persons attending
3        the special event increases the difficulty regarding:
4                (i) access to the persons who are attending the
5            special event who require emergency medical care;
6            or
7                (ii) the transfer of those persons who require
8            emergency medical care to an ambulance.
9    (b) In a county whose population is 100,000 or more, if the
10host organization meets the requirements of paragraph (1) or
11(2) of subsection (a) and 10,000 or more persons but less than
1215,000 persons are projected to be in attendance at the special
13event in the same place at the same time, the host organization
14shall:
15        (1) provide at least one first-aid station at the site
16    of the special event and equip the first-aid station with
17    an automated external defibrillator; and
18        (2) provide a roving emergency medical technician team
19    at the site of the special event.
20    (c) In a county whose population is 100,000 or more, if the
21host organization meets the requirements of paragraph (1) or
22(2) of subsection (a) and 15,000 or more persons but less than
2350,000 persons are projected to be in attendance at the special
24event in the same place at the same time, the host organization
25shall:
26        (1) provide at least one first-aid station at the site

1    of the special event and staff the first-aid station with
2    at least one registered nurse, licensed practical nurse, or
3    EMT-P in lieu of an EMT-B; and
4        (2) provide two or more roving intermediate emergency
5    medical technician teams at the site of the special event.

7    Sec. 5-45015. Ambulances.
8    (a) In a county whose population is 100,000 or more, if a
9special event at which 2,500 or more persons but less than
1015,000 persons are projected to be in attendance in the same
11place at the same time, the host organization shall provide at
12least one ambulance at the special event if the special event:
13        (1) is located more than 5 miles from the closest
14    hospital; or
15        (2) has been held before and there is a history of a
16    significant number of:
17            (A) contacts by emergency medical personnel with
18        persons who attended the special event to provide
19        emergency medical care to those persons; or
20            (B) persons who attended the special event who were
21        transported as patients from the special event to a
22        hospital.
23    (b) In a county whose population is 100,000 or more, if the
24    host organization meets the requirements of paragraph (1)
25    or (2) of subsection (a) and 15,000 or more persons but

1    less than 50,000 persons are projected to be in attendance
2    at the special event in the same place at the same time,
3    the host organization shall provide at least two ambulances
4    at the special event.

6    Sec. 5-45020. Special events of 50,000 or more. If a
7special event at which 50,000 or more persons are projected to
8be in attendance in the same place at the same time, the host
9organization shall provide:
10    (a) two or more first-aid stations at the site of the
11special event;
12    (b) two or more licensed physicians;
13    (c) two or more roving emergency medical technician teams;
14and
15    (d) two or more ambulances.

17    Sec. 5-45025. Home rule. A home rule unit may not regulate
18the provision of emergency medical services at special events
19in a manner less restrictive than the requirements under this
20Act. This Section is a limitation under subsection (i) of
21Section 6 of Article VII of the Illinois Constitution on the
22concurrent exercise by home rule units of powers and functions
23exercised by the State.

1    Section 10. The Illinois Municipal Code is amended by
2adding Division 153 to Article 11 and Sections 11-153-1,
311-153-2, 11-153-3, 11-153-4, and 11-153-5 as follows:

DIVISION 153. EMERGENCY MEDICAL SERVICE FOR SPECIAL EVENTS

 
6    (65 ILCS 5/11-153-1 new)
7    Sec. 11-153-1. Definitions. As used in this Division:
8    "Ambulance" means an ambulance or specialized emergency
9medical service vehicle ("SEMSV") designated under items (A) or
10(B) of paragraph (3) of subsection (a) of Section 3.85 of the
11Emergency Medical Services (EMS) Systems Act that:
12        (1) is capable of transporting a patient from a special
13    event to a hospital but, upon delivering the patient,

10        (1) provide at least one first-aid station at the site
11    of the special event and equip the first-aid station with
12    an automated external defibrillator; and
13        (2) provide a roving emergency medical technician team
14    at the site of the special event.
15    (c) In a county whose population is 100,000 or more, if the
16host organization meets the requirements of paragraph (1) or
17(2) of subsection (a) and 15,000 or more persons but less than
1850,000 persons are projected to be in attendance at the special
19event in the same place at the same time, the host organization
20shall:
21        (1) provide at least one first-aid station at the site
22    of the special event and staff the first-aid station with
23    at least one registered nurse, licensed practical nurse, or
24    EMT-P in lieu of an EMT-B; and
25        (2) provide two or more roving intermediate emergency
26    medical technician teams at the site of the special event.

7least one ambulance at the special event if the special event:
8        (1) is located more than 5 miles from the closest
9    hospital; or
10        (2) has been held before and there is a history of a
11    significant number of:
12            (A) contacts by emergency medical personnel with
13        persons who attended the special event to provide
14        emergency medical care to those persons; or
15            (B) persons who attended the special event who were
16        transported as patients from the special event to a
17        hospital.
18    (b) In a county whose population is 100,000 or more, if the
19    host organization meets the requirements of paragraph (1)
20    or (2) of subsection (a) and 15,000 or more persons but
21    less than 50,000 persons are projected to be in attendance
22    at the special event in the same place at the same time,
23    the host organization shall provide at least two ambulances
24    at the special event.
