AMENDMENT TO SENATE BILL 2144

2    AMENDMENT NO. ______. Amend Senate Bill 2144 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5changing Section 500-100 as follows:
 
6    (215 ILCS 5/500-100)
7    (Section scheduled to be repealed on January 1, 2017)
8    Sec. 500-100. Limited lines producer license.
9    (a) An individual who is at least 18 years of age and whom
10the Director considers to be competent, trustworthy, and of
11good business reputation may obtain a limited lines producer
12license for one or more of the following classes:
13        (1) insurance on baggage or limited travel health,
14    accident, or trip cancellation insurance sold in
15    connection with transportation provided by a common
16    carrier;

1        (2) industrial life insurance, as defined in Section
2    228 of this Code;
3        (3) industrial accident and health insurance, as
4    defined in Section 368 of this Code;
5        (4) insurance issued by a company organized under the
6    Farm Mutual Insurance Company Act of 1986;
7        (5) legal expense insurance;
8        (6) enrollment of recipients of public aid or medicare
9    in a health maintenance organization;
10        (7) a limited health care plan issued by an
11    organization having a certificate of authority under the
12    Limited Health Service Organization Act.
13    (a-5) An insurance navigator shall obtain a limited lines
14producer license for the purpose of advising qualified
15individuals under the federal Patient Protection and
16Affordable Care Act, as amended by the federal Health Care and
17Education Reconciliation Act of 2010, and any amendments
18thereto, about health plans offered through the Illinois Health
19Benefits Exchange and other State and federal health programs
20as may be available. Insurance navigators must complete a
21training program in basic instruction about the Illinois Health
22Benefit Exchange, accident and health insurance business, and
23State and federal programs with which they will be assisting
24individuals. Insurance navigators may not receive any direct
25compensation or personal economic benefit for assisting
26individuals with respect to any particular health benefits

2    (b) The application for a limited lines producer license
3must be submitted on a form prescribed by the Director by a
4designee of the insurance company, health maintenance
5organization, or limited health service organization
6appointing the limited insurance representative. The insurance
7company, health maintenance organization, or limited health
8service organization must pay the fee required by Section
9500-135.
10    (c) A limited lines producer may represent more than one
11insurance company, health maintenance organization, or limited
12health service organization.
13    (d) An applicant who has met the requirements of this
14Section shall be issued a perpetual limited lines producer
15license.
16    (e) A limited lines producer license shall remain in effect
17as long as the appointing insurance company pays the respective
18fee required by Section 500-135 prior to January 1 of each
19year, unless the license is revoked or suspended pursuant to
20Section 500-70. Failure of the insurance company to pay the
21license fee or to submit the required documents shall cause
22immediate termination of the limited line insurance producer
23license with respect to which the failure occurs.
24    (f) A limited lines producer license may be terminated by
25the insurance company or the licensee.
26    (g) A person whom the Director considers to be competent,

1trustworthy, and of good business reputation may be issued a
2car rental limited line license. A car rental limited line
3license for a rental company shall remain in effect as long as
4the car rental limited line licensee pays the respective fee
5required by Section 500-135 prior to the next fee date unless
6the car rental license is revoked or suspended pursuant to
7Section 500-70. Failure of the car rental limited line licensee
8to pay the license fee or to submit the required documents
9shall cause immediate suspension of the car rental limited line
10license. A car rental limited line license for rental companies
11may be voluntarily terminated by the car rental limited line
12licensee. The license fee shall not be refunded upon
13termination of the car rental limited line license by the car
14rental limited line licensee.
15    (h) A limited lines producer issued a license pursuant to
16this Section is not subject to the requirements of Section
17500-30.
18    (i) A limited lines producer license must contain the name,
19address and personal identification number of the licensee, the
20date the license was issued, general conditions relative to the
21license's expiration or termination, and any other information
22the Director considers proper. A limited line producer license,
23if applicable, must also contain the name and address of the
24appointing insurance company.
