Creates the Health Care Billing Practices Act. Requires a health care provider who provides treatment to a minor child to proportionally bill each parent for any amount that is not covered by insurance for the child if the billing amount due, after payment by the insurer, if any, is in excess of $50 and either the custodial or non-custodial parent has provided the health care provider with a certified copy of the court order requiring the proportional payment of the health care expenses of the child. Provides that a parent taking a child to visit a health care provider shall be responsible for providing the health care provider with the most recent copy of any court order that proportions payment of health care expenses between the custodial and non-custodial parent. Provides that the provisions of the Act apply only to billing practices of a health care provider and shall not limit the health care provider's ability to collect unpaid medical expenses. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the Health |
5 | | Care Billing Practices Act. |
6 | | Section 5. Definition. As used in this Act:
|
7 | | "Health care provider" means a person who is licensed, |
8 | | certified, or otherwise authorized by the law of this State to |
9 | | administer health care in the ordinary course of business or |
10 | | practice of a profession including, but not limited to, a |
11 | | physician, dentist, podiatrist, nurse, physician assistant, or |
12 | | hospital facility. |
13 | | Section 10. Billing requirements. A health care provider |
14 | | who provides treatment to a minor child shall proportionally |
15 | | bill each parent for any amount that is not covered by |
16 | | insurance for the child, if: |
17 | | (1) the billing amount due, after payment by the |
18 | | insurer, if any, is in excess of $50; and |
19 | | (2) either the custodial or non-custodial parent has |
20 | | provided the health care provider with a certified copy of |
21 | | the court order requiring the proportional payment of |
22 | | health care expenses of the child. |
