AMENDMENT TO SENATE BILL 1937

2    AMENDMENT NO. ______. Amend Senate Bill 1937 on page 3, by
3replacing lines 3 through 8 with the following:
4    ""Person with a disability" means a person unable to engage
5in any substantial gainful activity by reason of a medically
6determinable physical or mental impairment which can be
7expected to result in death or has lasted or can be expected to
8last for a continuous period of not less than 12 months."; and
 
9on page 3, by replacing lines 16 through 18 with the following:
10"year. Household income does not include the income of any
11person with a disability who is a member of the applicant's
12household, as defined in this Section, and is a dependent of
13the applicant."; and
 
14on page 10, by replacing lines 7 through 19 with the following:
15    "If any applicant's household contains a person with a
16disability who is a dependent of the applicant, and if that

1person's income is not reported as part of the applicant's
2household income on an application for an exemption under this
3Section, then that applicant shall submit proof of the
4disability in such form and manner as the Department shall by
5rule and regulation prescribe. Proof that the person with a
6disability is eligible to receive disability benefits under the
7Federal Social Security Act shall constitute proof of
8disability for purposes of this Act. Issuance of an Illinois
9Person with a Disability Identification Card stating that the
10person with a disability is under a Class 2 disability, as
11defined in Section 4A of the Illinois Identification Card Act,
12shall constitute proof that the person named thereon is a
13disabled person for purposes of this Act. A disabled person not
14covered under the Federal Social Security Act and not
15presenting an Illinois Person with a Disability Identification
16Card stating that the claimant is under a Class 2 disability
17shall be examined by a physician designated by the Department,
18and his status as a disabled person determined using the same
19standards as used by the Social Security Administration. The
20costs of any required examination shall be borne by the
21applicant.".
