SYNOPSIS AS INTRODUCED:

    Amends the Illinois Clinical Laboratory and Blood Bank Act. Removes the definition of "therapeutic optometrist" and replaces it with a definition of "optometrist". In a provision concerning the examination of specimens, provides that a clinical laboratory shall examine specimens only at the request of, among others, a licensed optometrist (instead of a therapeutic optometrist for diagnostic or therapeutic purposes related to the use of diagnostic topical or therapeutic ocular pharmaceutical agents). Provides that an optometrist licensed in Illinois (instead of a therapeutic optometrist) may include certain information concerning a diagnosis or other matters on a laboratory report form.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Clinical Laboratory and Blood Bank
5Act is amended by changing Sections 2-127.5, 7-101, and 7-102
6as follows:
 
7    (210 ILCS 25/2-127.5)
8    Sec. 2-127.5. Optometrist Therapeutic optometrist.
9"Optometrist" "Therapeutic optometrist" means a person who is
10licensed in Illinois to practice optometry and who is
11therapeutically certified.

14    Sec. 7-101. Examination of specimens. A clinical
15laboratory shall examine specimens only at the request of (i) a
16licensed physician, (ii) a licensed dentist, (iii) a licensed
17podiatrist, (iv) a licensed therapeutic optometrist for
18diagnostic or therapeutic purposes related to the use of
19diagnostic topical or therapeutic ocular pharmaceutical
20agents, as defined in subsections (c) and (d) of Section 15.1
21of the Illinois Optometric Practice Act of 1987, (v) a licensed
22physician assistant in accordance with the written guidelines

1required under subdivision (3) of Section 4 and under Section
27.5 of the Physician Assistant Practice Act of 1987, (v-A) an
3advanced practice nurse in accordance with the written
4collaborative agreement required under Section 65-35 of the
5Nurse Practice Act, (vi) an authorized law enforcement agency
6or, in the case of blood alcohol, at the request of the
7individual for whom the test is to be performed in compliance
8with Sections 11-501 and 11-501.1 of the Illinois Vehicle Code,
9or (vii) a genetic counselor with the specific authority from a
10referral to order a test or tests pursuant to subsection (b) of
11Section 20 of the Genetic Counselor Licensing Act. If the
12request to a laboratory is oral, the physician or other
13authorized person shall submit a written request to the
14laboratory within 48 hours. If the laboratory does not receive
15the written request within that period, it shall note that fact
16in its records. For purposes of this Section, a request made by
17electronic mail or fax constitutes a written request.

20    Sec. 7-102. Reports of test results. The result of a test
21shall be reported directly to the licensed physician or other
22authorized person who requested it. No interpretation,
23diagnosis or prognosis or suggested treatment shall appear on
24the laboratory report form except that a report made by a
25physician licensed to practice medicine in Illinois, a dentist

1licensed in Illinois, or an a therapeutic optometrist licensed
2in Illinois may include such information. Nothing in this Act
3prohibits the sharing of information as authorized in Section
42.1 of the Department of Public Health Act.
