1 | | coterminous, municipality in which the city council exercises |
2 | | the powers and duties of the township board, or in which one or |
3 | | more municipal officials serve as an officer or trustee of the |
4 | | township; (2) is located within a county with a population of 3 |
5 | | million or more; and (3) contains a territory of 7 square miles |
6 | | or more. |

8 | | Sec. 27-10. Petition and referendum to discontinue and |
9 | | abolish a township organization within a coterminous |
10 | | municipality. Upon ordinance adopted by the city council of a |
11 | | township described under Section 27-5 of this Article, or upon |
12 | | petition of at least 10% of the registered voters of that |
13 | | township, the city council shall certify and cause to be |
14 | | submitted to the voters of the township, at the next election |
15 | | or consolidated election, a proposition to discontinue and |
16 | | abolish the township organization and to transfer all the |
17 | | rights, powers, duties, assets, property, liabilities, |
18 | | obligations, and responsibilities of the township organization |
19 | | to the coterminous municipality. |
20 | | A signature on a petition shall not be valid or counted in |
21 | | considering the petition unless the form requirements are |
22 | | complied with and the date of each signature is less than 90 |
23 | | days before the last day for filing the petition. The statement |
24 | | of the person who circulates the petition must include an |
25 | | attestation (i) indicating the dates on which that sheet was |

1 | | circulated, (ii) indicating the first and last date on which |
2 | | that sheet was circulated, or (iii) certifying that none of the |
3 | | signatures on the sheet was signed more than 90 days before the |
4 | | last day for filing the petition. The petition shall be treated |
5 | | and the proposition certified in the manner provided by the |
6 | | general election law. After the proposition has once been |
7 | | submitted to the electorate, the proposition shall not be |
8 | | resubmitted for 4 years. |
9 | | The proposition shall be in substantially the following |
10 | | form: |
11 | | Shall the township organization be continued in [Name |
12 | | of Township] Township? |
13 | | The votes shall be recorded as "Yes" or "No". |

15 | | Sec. 27-15. Cessation of township organization. If a |
16 | | majority of the votes of the township cast are in favor of the |
17 | | proposition to discontinue and abolish the township |
18 | | organization, then the township organization in that township |
19 | | shall cease. |
20 | | On the effective date of the discontinuance and abolishment |
21 | | of the township organization, all the rights, powers, duties, |
22 | | assets, property, liabilities, obligations, and |
23 | | responsibilities of the township shall by operation of law vest |
24 | | in and be assumed by the coterminous municipality. |

2 | | Sec. 27-20. Township officers. |
3 | | Upon the effective date of discontinuance, the coterminous |
4 | | municipality shall exercise all duties and responsibilities of |
5 | | that township officer as provided in the Township Code, the |
6 | | Illinois Public Aid Code, Property Tax Code, and the Illinois |
7 | | Highway Code, as applicable. The coterminous municipality may |
8 | | enter into an intergovernmental agreement or contract with the |
9 | | county or the State to administer the duties and |
10 | | responsibilities of that township officer for services under |
11 | | its jurisdiction. |

13 | | Sec. 27-25. Business, records, and property of |
14 | | discontinued township organization. The records of a township |
15 | | organization discontinued under this Article shall be |
16 | | deposited in the coterminous municipality's city clerk's |
17 | | office. The coterminous municipality may close up all |
18 | | unfinished business of the township and sell and dispose of any |
19 | | of the property belonging to the township for benefit of the |
20 | | inhabitants of the municipality. |
21 | | Section 15. The Public Health District Act is amended by |
22 | | adding Section 25 as follows: |

1 | | Sec. 25. Discontinuance of a coterminous township. If the |
2 | | office of Township Assessor in a coterminous township is |
3 | | discontinued as provided in Article 27 of the Township Code, |
4 | | then the coterminous municipality's Council members shall be |
5 | | the board of health for the public health district under this |
6 | | Act. |
7 | | Section 20. The Illinois Public Aid Code is amended by |
8 | | adding Section 12-3.1 as follows: |

10 | | Sec. 12-3.1. Discontinuance of a coterminous township. |
11 | | Upon discontinuance of a coterminous township under Article 27 |
12 | | of the Township Code, the coterminous municipality shall |
13 | | provide funds for and administer the public aid program |
14 | | provided for under Article VI of this Code. |
15 | | Section 25. The Illinois Highway Code is amended by adding |
16 | | Section 5-205.10 as follows: |

18 | | Sec. 5-205.10. Discontinuance of a coterminous township. |
19 | | If township organization is discontinued as provided in Article |
20 | | 27 of the Township Code, then the coterminous municipality |
21 | | shall assume the duties of highway commissioner under this |
22 | | Code.
