SYNOPSIS AS INTRODUCED:
 
30 ILCS 500/45-58 new

    Amends the Illinois Procurement Code. Requires that a preference equal to 10% of the contract amount be granted to an otherwise qualified State contract bidder that is a qualified veteran. Defines a qualified veteran as a business entity 51% or more owned by one or more veterans. Sets as a goal that each fiscal year the State award at least 3% of the value of its total contracts to qualified veterans. Requires that the Department of Central Management Services report annually to the General Assembly on the attainment of the percentage goal, based on information reported by chief procurement officers. Requires chief procurement officers to make recommendations on the percentage goal, with input from statewide veterans' service organizations and the business community. Requires the Governor to recommend to the General Assembly changes in programs to assist qualified veterans.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Procurement Code is amended by
5adding Section 45-58 as follows:
 
6    (30 ILCS 500/45-58 new)
7    Sec. 45-58. Veterans.
8    (a) When a contract is awarded under this Code, a
9preference of up to 10% of the amount of the contract shall be
10given to a qualified veteran. If the qualified veteran
11otherwise meets the requirements of the contract solicitation
12and with the preference is the lowest bidder, the contract
13shall be awarded to the qualified veteran. If 2 or more
14qualified veterans are the lowest bidders on a contract, all
15other things being equal, the qualified veteran with the lowest
16bid shall be awarded the contract.
17    (b) It is the goal of the State to award each fiscal year
18not less than 3% of its total expenditures for contracts
19awarded under this Code to qualified veterans. That portion of
20a contract under which the contractor subcontracts with a
21qualified veteran may be counted toward the goal of this
22subsection.
23    (c) By each September 1, each chief procurement officer

1shall report to the Department of Central Management Services
2on all of the following for the immediately preceding fiscal
3year, and by each October 1 the Department of Central
4Management Services shall compile and report that information
5to the General Assembly:
6        (1) The number of qualified veterans who submitted a
7    bid for a contract under this Code.
8        (2) The number of qualified veterans who entered into
9    contracts with the State under this Code and the total
10    value of those contracts.
11        (3) Whether the State achieved the goal described in
12    subsection (b).
13        (4) The recommendations described in subsection (d).
14    (d) Each year, each chief procurement officer shall review
15the progress of all State agencies under its jurisdiction in
16meeting the goal described in subsection (b), with input from
17statewide veterans' service organizations and from the
18business community, including businesses owned by qualified
19veterans, and shall make recommendations to be included in the
20Department of Central Management Services' report to the
21General Assembly regarding continuation, increases, or
22decreases of the percentage goal. The recommendations shall be
23based upon the number of businesses that are owned by qualified
24veterans and on the continued need to encourage and promote
25businesses owned by qualified veterans.
26    (e) To assist the State in reaching the goal described in

1subsection (b), the Governor shall recommend to the General
2Assembly changes in programs to assist businesses owned by
3qualified veterans.
4    (f) As used in this Section:
5    "Qualified veteran" means a business entity that is 51% or
6more owned by one or more veterans.
7    "Veteran" means a person who served in the active military,
8naval, or air service and who was discharged or released from
9his or her service under conditions other than dishonorable.
