AMENDMENT TO SENATE BILL 722

2    AMENDMENT NO. ______. Amend Senate Bill 722 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Liquor Control Act of 1934 is amended by
5changing Section 6-33 as follows:
 
6    (235 ILCS 5/6-33)
7    Sec. 6-33. Sealing and removal of open wine bottles from a
8restaurant or winery. Notwithstanding any other provision of
9this Act, a restaurant licensed to sell alcoholic liquor in
10this State may permit a patron to remove one unsealed and
11partially consumed bottle of wine for off-premise consumption
12provided that the patron has purchased a meal and consumed a
13portion of the bottle of wine with the meal on the restaurant
14premises. Notwithstanding any other provision of this Act, a
15winery licensed to sell alcoholic liquor in this State may
16permit a patron to remove one unsealed and partially consumed

1bottle of wine for off-premise consumption. A partially
2consumed bottle of wine that is to be removed from the premises
3pursuant to this Section shall be securely sealed by the
4licensee or an agent of the licensee prior to removal from the
5premises and placed in a transparent one-time use tamper-proof
6bag. The licensee or agent of the licensee shall provide a
7dated receipt for the bottle of wine to the patron. Wine that
8is resealed in accordance with the provisions of this Section
9and not tampered with and transported in accordance with the
10restrictions of subsections (a) and (b) of Section 11-502 of
11the Illinois Vehicle Code shall not be deemed to violate
12Section 11-502 of the Illinois Vehicle Code.
