1 | | AN ACT concerning liquor.

2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Liquor Control Act of 1934 is amended by |
5 | | changing Section 6-33 as follows:

7 | | Sec. 6-33. Sealing and removal of open wine bottles from a |
8 | | restaurant or winery . Notwithstanding any other provision of |
9 | | this Act, a restaurant licensed to sell alcoholic liquor in |
10 | | this State may permit a patron to remove one unsealed and |
11 | | partially consumed bottle of wine for off-premise consumption |
12 | | provided that the patron has purchased a meal and consumed a |
13 | | portion of the bottle of wine with the meal on the restaurant |
14 | | premises. Notwithstanding any other provision of this Act, a |
15 | | winery licensed to sell alcoholic liquor in this State may |
16 | | permit a patron to remove one unsealed and partially consumed |
17 | | bottle of wine for off-premise consumption. A partially |
18 | | consumed bottle of wine that is to be removed from the premises |
19 | | pursuant to this Section shall be securely sealed by the |
20 | | licensee or an agent of the licensee prior to removal from the |
21 | | premises and placed in a transparent one-time use tamper-proof |
22 | | bag. The licensee or agent of the licensee shall provide a |
23 | | dated receipt for the bottle of wine to the patron. Wine that |
