| 1 | | AN ACT concerning local government.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Counties Code is amended by changing Section |
| 5 | | 3-3009 as follows:
|
| 6 | | (55 ILCS 5/3-3009) (from Ch. 34, par. 3-3009)

| 7 | | Sec. 3-3009.
Deputy coroner's, sheriff's or police |
| 8 | | officer's performance
of coroner's
duties. If there is no |
| 9 | | coroner, or it shall appear in like manner that he or she
is |
| 10 | | also a party to or interested in the suit, or of kin, or |
| 11 | | partial to or
prejudiced against either party, or the coroner |
| 12 | | has an economic or personal interest that conflicts with his or |
| 13 | | her official duties as coroner, the coroner shall disqualify |
| 14 | | himself or herself from acting at an investigation or inquest |
| 15 | | and process shall may in like manner issue to the
deputy |
| 16 | | coroner if designated by the coroner to fill the vacancy, or, |
| 17 | | if no
designation is
made, to any
sheriff, sheriff's deputy or |
| 18 | | police officer, in the county, who shall
perform like duties as |
| 19 | | required of the coroner.
The designation shall be in writing |
| 20 | | and filed with the county clerk.
