4 | | "Section 5. The State Police Act is amended by changing |
5 | | Section 9 as follows:

7 | | Sec. 9. Appointment; qualifications.
|
8 | | (a) Except as otherwise provided in this Section, the |
9 | | appointment of
Department of State Police officers shall be |
10 | | made from those applicants who
have been certified by the Board |
11 | | as being qualified for appointment. All
persons so appointed |
12 | | shall, at the time of their appointment, be not less than
21 |
13 | | years of age, or 20 years of age and have successfully |
14 | | completed 2 years of
law enforcement studies at an accredited |
15 | | college or university. Any person
appointed subsequent to |
16 | | successful completion of 2 years of such law
enforcement |

1 | | studies shall not have power of arrest, nor shall he be |
2 | | permitted
to carry firearms, until he reaches 21 years of age. |
3 | | In addition,
all persons so certified for appointment shall be |
4 | | of sound mind and body, be of
good moral character, be citizens |
5 | | of the United States, have no criminal
records, possess such |
6 | | prerequisites of training, education and experience as
the |
7 | | Board may from time to time prescribe, and shall be required to |
8 | | pass
successfully such mental and physical tests and |
9 | | examinations as may be
prescribed by the Board. Notwithstanding |
10 | | any Board rule to the contrary, all persons who either: (i) |
11 | | have been honorably discharged and who have been awarded a |
12 | | Southwest Asia Service Medal, Kosovo Campaign Medal, Korean |
13 | | Defense Service Medal, Afghanistan Campaign Medal, Iraq |
14 | | Campaign Medal, or Global War on Terrorism Expeditionary Medal |
15 | | by the United States Armed Forces or (ii) are active members of |
16 | | the Illinois National Guard or a reserve component of the |
17 | | United States Armed Forces and who have been awarded a |
18 | | Southwest Asia Service Medal, Kosovo Campaign Medal, Korean |
19 | | Defense Service Medal, Afghanistan Campaign Medal, Iraq |
20 | | Campaign Medal, or Global War on Terrorism Expeditionary Medal |
21 | | as a result of honorable service during deployment on active |
22 | | duty, are deemed to have met the collegiate educational |
23 | | requirements. All persons who have been honorably discharged |
24 | | and who have been awarded an Afghan or Iraqi campaign medal by |
25 | | the military or naval services of the United States are deemed |
26 | | to have met the collegiate educational requirements, |

1 | | notwithstanding any Board rule. Preference shall be given in |
2 | | such appointments to
persons who have honorably served in the |
3 | | military or naval services of the
United States. All appointees |
4 | | shall serve a probationary period of 12 months
from the date of |
5 | | appointment and during that period may be discharged at the
|
6 | | will of the Director. However, the Director may in his or her |
7 | | sole discretion
extend the probationary period of an officer up |
8 | | to an additional 6 months when
to do so is deemed in the best |
9 | | interest of the Department.
|
10 | | (b) Notwithstanding the other provisions of this Act, after |
11 | | July 1,
1977 and before July 1, 1980, the Director of State |
12 | | Police may appoint and
promote not more than 20 persons having |
13 | | special qualifications as special
agents as he deems necessary |
14 | | to carry out the Department's objectives. Any
such appointment |
15 | | or promotion shall be ratified by the Board.

16 | | (c) During the 90 days following the effective date of this |
17 | | amendatory Act
of 1995, the Director of State Police may |
18 | | appoint up to 25 persons as State
Police officers. These |
19 | | appointments shall be made in accordance with the
requirements |
20 | | of this subsection (c) and any additional criteria that may be
|
21 | | established by the Director, but are not subject to any other |
22 | | requirements of
this Act. The Director may specify the initial |
23 | | rank for each person appointed
under this subsection.
|
24 | | All appointments under this subsection (c) shall be made |
25 | | from personnel
certified by the Board. A person certified by |
26 | | the Board and appointed by the
Director under this subsection |

1 | | must have been employed by the Illinois Commerce
Commission on |
2 | | November 30, 1994 in a job title
subject to the Personnel Code |
3 | | and in a position for which the person was
eligible to earn |
4 | | "eligible creditable service" as a "noncovered employee", as
|
5 | | those terms are defined in Article 14 of the Illinois Pension |
6 | | Code.
|
7 | | Persons appointed under this subsection (c) shall |
8 | | thereafter be subject to
the same requirements and procedures |
9 | | as other State police officers. A person
appointed under this |
10 | | subsection must serve a probationary period of 12 months
from |
11 | | the date of appointment, during which he or she may be |
12 | | discharged at the
will of the Director.

13 | | This subsection (c) does not affect or limit the Director's |
14 | | authority to
appoint other State Police officers under |
15 | | subsection (a) of this Section.
