AMENDMENT TO SENATE BILL 204

2    AMENDMENT NO. ______. Amend Senate Bill 204 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Police Act is amended by changing
5Section 9 as follows:
 
6    (20 ILCS 2610/9)  (from Ch. 121, par. 307.9)
7    Sec. 9. Appointment; qualifications.
8    (a) Except as otherwise provided in this Section, the
9appointment of Department of State Police officers shall be
10made from those applicants who have been certified by the Board
11as being qualified for appointment. All persons so appointed
12shall, at the time of their appointment, be not less than 21
13years of age, or 20 years of age and have successfully
14completed 2 years of law enforcement studies at an accredited
15college or university. Any person appointed subsequent to
16successful completion of 2 years of such law enforcement

1studies shall not have power of arrest, nor shall he be
2permitted to carry firearms, until he reaches 21 years of age.
3In addition, all persons so certified for appointment shall be
4of sound mind and body, be of good moral character, be citizens
5of the United States, have no criminal records, possess such
6prerequisites of training, education and experience as the
7Board may from time to time prescribe, and shall be required to
8pass successfully such mental and physical tests and
9examinations as may be prescribed by the Board. Notwithstanding
10any Board rule to the contrary, all persons who either: (i)
11have been honorably discharged and who have been awarded a
12Southwest Asia Service Medal, Kosovo Campaign Medal, Korean
13Defense Service Medal, Afghanistan Campaign Medal, Iraq
14Campaign Medal, or Global War on Terrorism Expeditionary Medal
15by the United States Armed Forces or (ii) are active members of
16the Illinois National Guard or a reserve component of the
17United States Armed Forces and who have been awarded a
18Southwest Asia Service Medal, Kosovo Campaign Medal, Korean
19Defense Service Medal, Afghanistan Campaign Medal, Iraq
20Campaign Medal, or Global War on Terrorism Expeditionary Medal
21as a result of honorable service during deployment on active
22duty, are deemed to have met the collegiate educational
23requirements. All persons who have been honorably discharged
24and who have been awarded an Afghan or Iraqi campaign medal by
25the military or naval services of the United States are deemed
26to have met the collegiate educational requirements,

1notwithstanding any Board rule. Preference shall be given in
2such appointments to persons who have honorably served in the
3military or naval services of the United States. All appointees
4shall serve a probationary period of 12 months from the date of
5appointment and during that period may be discharged at the
6will of the Director. However, the Director may in his or her
7sole discretion extend the probationary period of an officer up
8to an additional 6 months when to do so is deemed in the best
9interest of the Department.
10    (b) Notwithstanding the other provisions of this Act, after
11July 1, 1977 and before July 1, 1980, the Director of State
12Police may appoint and promote not more than 20 persons having
13special qualifications as special agents as he deems necessary
14to carry out the Department's objectives. Any such appointment
15or promotion shall be ratified by the Board.
16    (c) During the 90 days following the effective date of this
17amendatory Act of 1995, the Director of State Police may
18appoint up to 25 persons as State Police officers. These
19appointments shall be made in accordance with the requirements
20of this subsection (c) and any additional criteria that may be
21established by the Director, but are not subject to any other
22requirements of this Act. The Director may specify the initial
23rank for each person appointed under this subsection.
24    All appointments under this subsection (c) shall be made
25from personnel certified by the Board. A person certified by
26the Board and appointed by the Director under this subsection

1must have been employed by the Illinois Commerce Commission on
2November 30, 1994 in a job title subject to the Personnel Code
3and in a position for which the person was eligible to earn
4"eligible creditable service" as a "noncovered employee", as
5those terms are defined in Article 14 of the Illinois Pension
6Code.
7    Persons appointed under this subsection (c) shall
8thereafter be subject to the same requirements and procedures
9as other State police officers. A person appointed under this
10subsection must serve a probationary period of 12 months from
11the date of appointment, during which he or she may be
12discharged at the will of the Director.
13    This subsection (c) does not affect or limit the Director's
14authority to appoint other State Police officers under
15subsection (a) of this Section.
