SYNOPSIS AS INTRODUCED:

    Amends the Renewable Energy, Energy Efficiency, and Coal Resources Development Law of 1997. Extends the sunset of the Act until December 12, 2025. Amends the Illinois Coal Technology Development Assistance Act. Provides that, beginning on the effective date of the amendatory Act, any amounts that were required to be transferred to the Coal Technology Development Assistance Fund shall instead be transferred to the Renewable Energy Resources Fund. Provides that, upon the expenditure of all of the moneys remaining in the Coal Technology Development Assistance Fund on the effective date of the amendatory Act, that Fund shall be dissolved. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Renewable Energy, Energy Efficiency, and
5Coal Resources Development Law of 1997 is amended by changing
6Section 6-7 as follows:
 
7    (20 ILCS 687/6-7)
8    (Section scheduled to be repealed on December 12, 2015)
9    Sec. 6-7. Repeal. The provisions of this Law are repealed
10on December 12, 2025 December 12, 2015.

12    Section 10. The Illinois Coal Technology Development
13Assistance Act is amended by changing Sections 3 and 4 as
14follows:

16    Sec. 3. Transfers to Coal Technology Development
17Assistance Funds. As soon as may be practicable after the first
18day of each month, the Department of Revenue shall certify to
19the Treasurer an amount equal to 1/64 of the revenue realized
20from the tax imposed by the Electricity Excise Tax Law, Section
212 of the Public Utilities Revenue Act, Section 2 of the

1Messages Tax Act, and Section 2 of the Gas Revenue Tax Act,
2during the preceding month. Upon receipt of the certification,
3the Treasurer shall transfer the amount shown on such
4certification from the General Revenue Fund to the Coal
5Technology Development Assistance Fund, which is hereby
6created as a special fund in the State treasury, except that no
7transfer shall be made in any month in which the Fund has
8reached the following balance:
9        (1) $7,000,000 during fiscal year 1994.
10        (2) $8,500,000 during fiscal year 1995.
11        (3) $10,000,000 during fiscal years 1996 and 1997.
12        (4) During fiscal year 1998 through fiscal year 2004,
13    an amount equal to the sum of $10,000,000 plus additional
14    moneys deposited into the Coal Technology Development
15    Assistance Fund from the Renewable Energy Resources and
16    Coal Technology Development Assistance Charge under
17    Section 6.5 of the Renewable Energy, Energy Efficiency, and
18    Coal Resources Development Law of 1997.
19        (5) During fiscal year 2005, an amount equal to the sum
20    of $7,000,000 plus additional moneys deposited into the
21    Coal Technology Development Assistance Fund from the
22    Renewable Energy Resources and Coal Technology Development
23    Assistance Charge under Section 6.5 of the Renewable
24    Energy, Energy Efficiency, and Coal Resources Development
25    Law of 1997.
26        (6) During fiscal year 2006 and each fiscal year

1    thereafter, an amount equal to the sum of $10,000,000 plus
2    additional moneys deposited into the Coal Technology
3    Development Assistance Fund from the Renewable Energy
4    Resources and Coal Technology Development Assistance
5    Charge under Section 6.5 of the Renewable Energy, Energy
6    Efficiency, and Coal Resources Development Law of 1997.
7    Notwithstanding any other provision of law, no transfers
8shall be made to the Coal Technology Development Assistance
9Fund under this Section on or after the effective date of this
10amendatory Act of the 98th General Assembly. Beginning on the
11effective date of this amendatory Act of the 98th General
12Assembly, any amounts that were required to be transferred to
13the Coal Technology Development Assistance Fund under this
14Section shall instead be transferred to the Renewable Energy
15Resources Fund.

18    Sec. 4. Expenditures from Coal Technology Development
19Assistance Fund.
20    (a) The contents of the Coal Technology Development
21Assistance Fund may be expended, subject to appropriation by
22the General Assembly, in such amounts and at such times as the
23Department, with the advice and recommendation of the Board,
24may deem necessary or desirable for the purposes of this Act.
25    (b) The Department shall develop a written plan containing

1measurable 3-year and 10-year goals and objectives in regard to
2the funding of coal research and coal demonstration and
3commercialization projects, and programs designed to preserve
4and enhance markets for Illinois coal. In developing these
5goals and objectives, the Department shall consider and
6determine the appropriate balance for the achievement of
7near-term and long-term goals and objectives and of ensuring
8the timely commercial application of cost-effective
9technologies or energy and chemical production processes or
10systems utilizing coal. The Department shall develop the
11initial goals and objectives no later than December 1, 1993,
12and develop revised goals and objectives no later than July 1
13annually thereafter.
14    (c) (Blank).
15    (d) As soon as all of the moneys remaining in the Coal
16Technology Development Assistance Fund on the effective date of
17this amendatory Act of the 98th General Assembly have been
18expended, the Coal Technology Development Assistance Fund
19shall be dissolved.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.
