AMENDMENT TO HOUSE BILL 5689




2    AMENDMENT NO. ______. Amend House Bill 5689 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Illinois Poison Prevention Packaging Act is 
5amended  by changing Section 2 and  by adding Sections 2.10 and 
610 as follows:
 



7    (430 ILCS 40/2)  (from Ch. 111 1/2, par. 292)



8    Sec. 2. 


9    The words and phrases used in this Act have the meanings 
10set out in
Sections 2.01 to 2.10 2.05, unless the context 
11clearly indicates otherwise.

13    (430 ILCS 40/2.10  new)
14    Sec. 2.10. Electronic cigarettes. "Electronic  cigarette" 
15or "e-cigarette" means a  battery-operated  device that contains

1a combination  of  nicotine, flavor,  and chemicals that are 
2turned into vapor which is inhaled by the user.
 
3    (430 ILCS 40/10 new)
4    Sec. 10. Child-safe electronic cigarette liquids. 
5Electronic cigarette liquids sold and marketed for the 
6refilling of e-cigarettes may be sold only in special 
7packaging. The Department of Public Health shall adopt rules 
8establishing the standards for special packaging to be used for 
9e-cigarette liquids.
10    This Section does not apply to electronic cigarette 
11products sold in sealed, pre-filled, or disposable replacement 
12cartridges. 
 
 
13    Section 99. Effective date. This Act takes effect upon 
14becoming law.".
