Amends the Illinois Insurance Code. Provides that a group health plan and a health insurance issuer offering group or individual health insurance coverage may not
discriminate with respect to participation under the plan or coverage
against any health care provider who is acting within the scope of that
provider's license or certification under applicable State law. Provides that group health plans and health insurance issuers may not refuse to accept certain types of providers into a network solely on the basis of their type of licensure. Provides that nothing in the provision concerning nondiscrimination in health care shall be construed as preventing a group health plan, a health insurance issuer, or the Department of Insurance from establishing varying reimbursement rates based on quality or performance measures.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Insurance Code is amended by adding |
5 | | Section 370b.1 as follows: |

7 | | Sec. 370b.1. Nondiscrimination in health care. A group |
8 | | health plan and a health insurance issuer offering group or |
9 | | individual health insurance coverage may not

12 | | provider's license or certification under applicable State |
13 | | law. Group health plans and health insurance issuers may not |
