2 | | AMENDMENT NO. ______. Amend House Bill 4612 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The School Code is amended by adding Section |
5 | | 29-20 as follows: |
6 | | (105 ILCS 5/29-20 new) |
7 | | Sec. 29-20. Transportation for school districts with |
8 | | shared service agreements. The State Board of Education shall |
9 | | create a pilot program allowing school districts to achieve |
10 | | savings through shared service agreements in providing |
11 | | transportation to students. This pilot program shall begin on |
12 | | January 1, 2015 and expire on January 1, 2018. Under the pilot |
13 | | program, any 2 or more school districts that share one or more |
14 | | boundaries may combine transportation activities to, in |
15 | | addition to the variety of economic, environmental, and traffic |
16 | | safety benefits, achieve savings to these school districts as |

1 | | well as this State. Any shared service agreement entered into |
2 | | for the purposes of this Section must be reduced to writing and |
3 | | forwarded to the State Board of Education prior to the |
4 | | effective date of that agreement. For any school districts |
5 | | electing to combine such transportation, the State Board of |
6 | | Education shall reimburse the school districts in an amount in |
7 | | addition to any other transportation reimbursement or other |
8 | | moneys owed to the school districts. In calculating this |
9 | | reimbursement, the State Board of Education shall reimburse |
10 | | school districts in the year following the year in which |
11 | | savings were achieved in an amount deemed equal to 50% of the |
12 | | actual or estimated savings achieved by this State from any |
13 | | reductions in other reimbursement the consolidation achieved. |
14 | | This additional reimbursement must be divided between or among |
15 | | the school districts by a percentage equal to the percentage of |
16 | | the total student population made up by each district's |
17 | | population. School districts may jointly enter into any |
18 | | contract not otherwise prohibited by this Article with other |
19 | | school districts or transportation providers to achieve these |
20 | | savings. In applying for reimbursement under this Section, |
21 | | school districts shall use forms prescribed by the State Board |
22 | | of Education, accompanied by any information requested by the |
23 | | State Board of Education or deemed useful by the school |
24 | | districts, including historic transportation information, |
25 | | mileage reductions, or information provided by vendors or |
26 | | consultants. School districts may enter into these shared |

1 | | service agreements for any period of time otherwise allowed by |
2 | | law, but in no case may they receive moneys under this Section |
3 | | on or after January 1, 2018. In estimating savings for multiple |
4 | | years under this Section, the State Board of Education shall |
5 | | estimate savings in each year achieved by the school districts; |
6 | | however, the final amount transferred under this Section may be |
7 | | changed in any year to reflect actual savings, and amounts may |
8 | | be reduced in a year if the previous year's moneys were |
9 | | transferred based on estimates that were not realized in that |
10 | | year.

11 | | Section 99. Effective date. This Act takes effect July 1, |
12 | | 2014.".
