2 | | (a) The Abraham Lincoln Presidential Library and Museum, |
3 | | formerly a constituent unit of the Illinois Historic |
4 | | Preservation Agency, is created as an independent State agency. |
5 | | (b) The Agency shall be under the supervision and direction |
6 | | of the Executive Director of the Abraham Lincoln
Presidential |
7 | | Library and Museum. |
8 | | (c) There shall
be a Board of the Abraham Lincoln |
9 | | Presidential Library and Museum to
advise the Abraham Lincoln |
10 | | Presidential Library and Museum and the Executive
Director on |
11 | | programs related to the Abraham Lincoln Presidential
Library |
12 | | and Museum. The Abraham Lincoln Presidential Library and Museum |
13 | | and the Abraham
Lincoln Presidential Library Foundation shall |
14 | | mutually
co-operate to maximize resources available to the |
15 | | Abraham Lincoln
Presidential Library and Museum and to support, |
16 | | sustain, and provide
educational programs and collections at |
17 | | the Abraham Lincoln
Presidential Library and Museum. |
18 | | Section 15. Board; initial members. |
19 | | (a) The Board of the
Abraham Lincoln Presidential Library |
20 | | and Museum shall consist of 11 members to
be appointed by the |
21 | | Governor, with the advice and consent of
the Senate. Each of |
22 | | these members shall have recognized
knowledge and ability in |
23 | | matters relating to history,
research, cultural institutions, |
24 | | archives, libraries,
business, or education. The terms of |
25 | | office of these members
shall be 6 years, except that the terms |

|
1 | | of office of the
initial members shall commence from the |
2 | | effective date of
this Act and run as provided under subsection |
3 | | (b) of this Section. |
4 | | (b) The appointees that currently serve, as of the |
5 | | effective date of this Act, on the Advisory Board of the |
6 | | Lincoln Presidential Library and Museum previously created |
7 | | under Section 30 of the Historic Preservation Agency Act (now |
8 | | repealed) shall serve as the initial members of the Board |
9 | | created under Section 10 of this Act until they complete the |
10 | | unexpired portions of the terms to which they were appointed |
11 | | under Section 31 of the Historic Preservation Agency Act (now |
12 | | repealed) or until the Governor appoints a successor to replace |
13 | | the initial member. Successors, including a new Chairperson, |
14 | | shall be appointed by the Governor in accordance with |
15 | | subsection (a) of this Section. |
16 | | Section 20. Powers and duties of the Board. The Board
shall |
17 | | have the following powers and duties: |
18 | | (a) Establish programs for implementation in support of
the |
19 | | mission and goals of the Abraham Lincoln Presidential Library |
20 | | and Museum. |
21 | | (b) Create and execute such seminars, symposia, or other
|
22 | | conferences as may be necessary or advisable to the Abraham |
23 | | Lincoln
Presidential Library and Museum. |
24 | | (c) Report annually to the Governor and the General
|
25 | | Assembly
on the status of the Abraham Lincoln Presidential |
|

1 | | Library and Museum and its
programs. |
2 | | (d) Hire agents and employees necessary to carry out the |
3 | | duties and purposes of the Abraham Lincoln Presidential Library |
4 | | and Museum. |
5 | | (e) Accept, hold, maintain, and administer, as trustee, |
6 | | property given in trust for educational or historic purposes |
7 | | for the benefit of the people of the State of Illinois and to |
8 | | dispose of any property under the terms of the instrument |
9 | | creating the trust. |
10 | | (f) Accept, hold, maintain, and administer donated |
11 | | property of historical significance such as books, papers, |
12 | | records, and personal property of any kind, including |
13 | | electronic and digital property, pursuant to gifting |
14 | | instruments, agreements, or deeds of gift and to enter into |
15 | | such agreements as may be necessary to carry out the Board's |
16 | | duties and responsibilities under this Section. |
17 | | (g) Lease concessions at the Library and Museum. All |
18 | | leases, for whatever period, shall be made subject to the |
19 | | written approval of the Governor. All concession leases |
20 | | extending for a period in excess of 10 years shall contain |
21 | | provisions for the Abraham Lincoln
Presidential Library and |
22 | | Museum to participate, on a percentage basis, in the revenues |
23 | | generated by any concession operation. |
24 | | (h) Enforce the laws of the State and the rules of the |
25 | | Abraham Lincoln
Presidential Library and Museum at the Library |
26 | | and Museum. |

|
1 | | (i) Cooperate with private organizations and agencies of |
2 | | the State of Illinois by providing areas and the use of staff |
3 | | personnel where feasible for the sale of publications on the |
4 | | historic and cultural heritage of the State and craft items |
5 | | made by Illinois craftsmen. These sales shall not conflict with |
6 | | existing concession agreements. The Board is authorized to |
7 | | negotiate and approve agreements with the organizations and |
8 | | agencies for a portion of the monies received from sales to be |
9 | | returned to the Abraham Lincoln
Presidential Library and Museum |
10 | | for the furtherance of interpretive and restoration programs. |
11 | | (j) Establish local bank or savings and loan association |
12 | | accounts, upon the written authorization of the Executive |
13 | | Director, to temporarily hold income received at any of its |
14 | | properties. The local accounts established under this |
15 | | subsection shall be in the name of the Abraham Lincoln
|
16 | | Presidential Library and Museum and shall be subject to regular |
17 | | audits. The balance in a local bank or savings and loan |
18 | | association account shall be forwarded to the Abraham Lincoln
|
19 | | Presidential Library and Museum for deposit with the State |
20 | | Treasurer on Monday of each week if the amount to be deposited |
21 | | in a fund exceeds $500. |
22 | | No bank or savings and loan association shall receive |
23 | | public funds as permitted by this Section, unless it has |
24 | | complied with the requirements established under Section 6 of |
25 | | the Public Funds Investment Act.

26 | | (k) Accept offers of gifts, gratuities, or grants from the |
|

|
1 | | federal government, its agencies, or offices, or from any |
2 | | person, firm, or corporation. |
3 | | (l) Subject to the provisions of the Illinois |
4 | | Administrative Procedure Act, make reasonable rules as may be |
5 | | necessary to discharge the duties of the Abraham Lincoln
|
6 | | Presidential Library and Museum. |
7 | | (m) Charge and collect admission fees and rental for access |
8 | | to and use of the facilities of the Library and Museum.
|
9 | | (n) Operate a restaurant, café, or other food serving |
10 | | facility at the Museum or to lease the operation of such a |
11 | | facility under reasonable terms and conditions; to provide |
12 | | vending services for food, beverages, or other products deemed |
13 | | necessary and proper, consistent with the mission and purposes |
14 | | of the Library and Museum. |
15 | | (o) To engage in marketing activities designed to promote |
16 | | the Library and Museum. In undertaking these activities, the |
17 | | Board may take all necessary steps with respect to products and |
18 | | services, including, but not limited to, retail sales, |
19 | | wholesale sales, direct marketing, mail order sales, telephone |
20 | | sales, advertising and promotion, purchase of product and |
21 | | materials inventory, design, printing and manufacturing of new |
22 | | products, reproductions, and adaptations, copyright and |
23 | | trademark licensing and royalty agreements, and payment of |
24 | | applicable taxes. In addition, the Board shall have the |
25 | | authority to sell advertising in its publications and printed |
26 | | materials. |

1 | | Section 25. Administration of the Abraham Lincoln |
2 | | Presidential
Library and Museum. The Board shall appoint an |
3 | | Executive Director of the Abraham Lincoln
Presidential Library |
4 | | and Museum. The Executive Director shall serve at the
pleasure |
5 | | of the Board. The Executive Director shall, subject
to |
6 | | applicable provisions of law, execute and discharge the
powers |
7 | | and duties of the Abraham Lincoln Presidential Library and |
8 | | Museum. The Executive
Director shall appoint:
(a) a Library |
9 | | Facilities Operations Director; and (b) a
Director of the |
10 | | Library. The Executive Director shall appoint
those other |
11 | | employees of the Abraham Lincoln Presidential Library and |
12 | | Museum and the Illinois State Historical Library as he or she |
13 | | deems
appropriate and shall fix the compensation of the Library
|
14 | | Facilities Operations Director, the Director of the Library, |
15 | | and other employees. The Executive
Director may establish and
|
16 | | collect admission and registration fees, may operate a gift
|
17 | | shop, and may publish and sell educational and informational
|
18 | | materials. |
19 | | Section 30. Gifts to the Illinois State Historical Library. |
20 | | Those programs, collections, and functions heretofore |
21 | | administered by
the Illinois State Historical Library or the |
22 | | Historical Preservation Agency's Historical Library
Division |
23 | | shall be administered by
the Abraham Lincoln Presidential |
24 | | Library and Museum. All gifts made specifically to the Illinois |

1 | | State Historical Library or the Historical Preservation |
2 | | Agency's Historical Library Division
shall remain at
all times |
3 | | within the Abraham Lincoln Presidential Library and Museum.

4 | | Section 35. Director of the Abraham Lincoln Presidential |
5 | | Library; historical collections. The Director of the Library |
6 | | may and is hereby
required to make all necessary
rules, |
7 | | regulations, and bylaws not inconsistent with law to carry into
|
8 | | effect the purposes of this Section in accordance with the |
9 | | State Historical Library Act and to procure from time to time |
10 | | as may be
possible and practicable, at reasonable cost, all |
11 | | books, pamphlets,
manuscripts, monographs, writings, and other |
12 | | material of historical
interest and useful to the historian |
13 | | bearing upon the political, physical,
religious, or social |
14 | | history of the State of Illinois from the earliest
known period |
15 | | of time. The Director of the Library may exchange
any books, |
16 | | pamphlets,
manuscripts, records, or other material which such |
17 | | library may acquire that
are of no historical interest or for |
18 | | any reason are of no value to it, with
any other library, |
19 | | school, or historical society. The Director of the Library |
20 | | shall
distribute volumes of the series known as the Illinois |
21 | | Historical
Collections now in print, and to be printed, to all |
22 | | who may apply for same
and who pay to the Library for such |
23 | | volumes an
amount fixed by the Director sufficient to cover the |
24 | | expenses of printing
and distribution of each volume received |
25 | | by such applicants. However, the
Director of the Library shall |

|
1 | | have authority to furnish not to exceed 25 of each of the
|
2 | | volumes of the Illinois Historical Collections, free of charge |
3 | | to each of
the authors and editors of the collections or parts |
4 | | thereof; to furnish, as
in his or her discretion he or she |
5 | | deems necessary or
desirable, a reasonable number
of each of |
6 | | the volumes of the Collections without charge to archives,
|
7 | | libraries, and similar institutions from which material has |
8 | | been drawn or
assistance has been given in the preparation of |
9 | | such Collections, and to
the officials thereof; to furnish, as |
10 | | in his or her discretion he
or she deems
necessary or |
11 | | desirable, a reasonable number of each of the volumes of the
|
12 | | Collections without charge to the University of Illinois |
13 | | Library and to
instructors and officials of that University, |
14 | | and to public libraries in
the State of Illinois. The Director |
15 | | of the Library may also make exchanges of Historical
|
16 | | Collections with any other library, school, or historical |
17 | | society, and to
distribute volumes of collections for review |
18 | | purposes. |
19 | | Section 40. Separation from Historic Preservation Agency. |
20 | | On the effective date of this Act, all of the powers, duties, |
21 | | assets, liabilities,
employees, contracts, property, including |
22 | | any items formerly contained in the Illinois State Historical |
23 | | Library now presently held in the Abraham Lincoln Presidential |
24 | | Library and Museum, records, pending business, and
unexpended |
25 | | appropriations of the Historic Preservation Agency related
to |

1 | | the administration and enforcement of Sections 17, 30, 31, 32, |
2 | | and 33 of the Historic Preservation Agency Act (now repealed) |

transferred to the Abraham Lincoln Presidential Library and |
4 | | Museum created under this Act. |
5 | | The status and rights of the transferred employees, and the
|
6 | | rights of the State of Illinois and its agencies, under the
|
7 | | Personnel Code and applicable collective bargaining agreements
|
8 | | or under any pension, retirement, or annuity plan are not
|
9 | | affected (except as provided in Sections 14-110 and 18-127 of
|
10 | | the Illinois Pension Code) by that transfer or by any other
|
11 | | provision of this Act. |
12 | | Section 45. The Executive Reorganization Implementation |
13 | | Act is amended by changing Section 3.1 as follows:
|

6 | | Sec. 16. The Historic Sites and Preservation Division of |
7 | | the Agency
shall have the following
additional powers:
|
8 | | (a) To hire agents and employees necessary to carry out the |
9 | | duties and
purposes of the Historic Sites and Preservation |
10 | | Division of the Agency.
|
11 | | (b) To take all measures necessary to erect, maintain, |
12 | | preserve, restore,
and conserve all State Historic Sites and |
13 | | State Memorials, except when
supervision and maintenance is |
14 | | otherwise provided by law. This
authorization includes the |
15 | | power, with the consent of the Board, to enter
into contracts, |
16 | | acquire and
dispose of real and personal property, and enter |
17 | | into leases of real and
personal property. The Agency has the |
18 | | power to acquire, for purposes authorized by law, any real |
19 | | property in fee simple subject to a life estate in the seller |
20 | | in not more than 3 acres of the real property acquired, subject |
21 | | to the restrictions that the life estate shall be used for |
22 | | residential purposes only and that it shall be |
23 | | non-transferable.
|
24 | | (c) To provide recreational facilities including camp |
25 | | sites, lodges and
cabins, trails, picnic areas and related |
|

1 | | recreational facilities at all
sites under the jurisdiction of |
2 | | the Agency.
|
3 | | (d) To lay out, construct and maintain all needful roads, |

5 | | picnic areas, lodges and
cabins, and any other structures and |
6 | | improvements necessary and appropriate
in any State historic |
7 | | site or easement thereto; and to provide water
supplies, heat |
8 | | and light, and sanitary facilities for the public and living
|
9 | | quarters for the custodians and keepers of State historic |
10 | | sites.
|
11 | | (e) To grant licenses and rights-of-way within the areas |
12 | | controlled
by the Historic Sites and Preservation Division of |
13 | | the Agency for the
construction, operation
and maintenance |
14 | | upon,
under or across the property, of facilities for water, |
15 | | sewage, telephone,
telegraph, electric, gas, or other public |
16 | | service, subject to the terms and
conditions as may be |
17 | | determined by the Agency.
|
18 | | (f) To authorize the officers, employees and agents of the |
19 | | Historic Sites
and Preservation
Division of the Agency,
for the |
20 | | purposes of investigation and to exercise the rights,
powers, |
21 | | and duties vested and that may be vested in it, to enter and |
22 | | cross
all lands and waters in this State, doing no damage to |
23 | | private property.

24 | | (g) To transfer jurisdiction of or exchange any realty |
25 | | under the
control of the Historic Sites and Preservation |
26 | | Division of the Agency to
any other Department of
the State |

1 | | Government,
or to any agency of the Federal Government, or to |
2 | | acquire or accept Federal
lands, when any transfer, exchange, |
3 | | acquisition or acceptance is
advantageous to the State and is |
4 | | approved in writing by the Governor.
|
5 | | (h) To erect, supervise, and maintain all public monuments |
6 | | and memorials
erected by the State, except when the supervision |
7 | | and maintenance of
public monuments and memorials is otherwise |
8 | | provided by law.
|
9 | | (i) To accept, hold, maintain, and administer, as trustee, |
10 | | property given
in trust for educational or historic purposes |
11 | | for the benefit of the People
of the State of Illinois and to |
12 | | dispose, with the consent of the Board, of
any property under |
13 | | the terms of the
instrument creating the trust.
|
14 | | (j) To lease concessions on any property under the |
15 | | jurisdiction of the
Agency for a period not exceeding 25 years |
16 | | and to lease a concession
complex at Lincoln's New Salem State |
17 | | Historic Site for which a cash
incentive has been authorized |
18 | | under Section 5.1 of the Historic
Preservation Agency Act for a |
19 | | period not to exceed 40 years. All
leases, for whatever period, |
20 | | shall be made subject to the written approval
of the Governor. |
21 | | All concession leases extending for a period in excess of
10 |
22 | | years, will contain provisions for the Agency to participate, |
23 | | on a
percentage basis, in the revenues generated by any |
24 | | concession operation.
|
25 | | The Agency is authorized to allow for provisions for a |
26 | | reserve account and a leasehold account within Agency |
|

1 | | concession lease agreements for the purpose of setting aside |
2 | | revenues for the maintenance, rehabilitation, repair, |
3 | | improvement, and replacement of the concession facility, |
4 | | structure, and equipment of the Agency that are part of the |
5 | | leased premises. |
6 | | The lessee shall be required to pay into the reserve |
7 | | account a percentage of gross receipts, as set forth in the |
8 | | lease, to be set aside and expended in a manner acceptable to |
9 | | the Agency by the concession lessee for the purpose of ensuring |
10 | | that an appropriate amount of the lessee's moneys are provided |
11 | | by the lessee to satisfy the lessee's incurred responsibilities |
12 | | for the operation of the concession facility under the terms |
13 | | and conditions of the concession lease. |
14 | | The lessee account shall allow for the amortization of |
15 | | certain authorized expenses that are incurred by the concession |
16 | | lessee but that are not an obligation of the lessee under the |
17 | | terms and conditions of the lease agreement. The Agency may |
18 | | allow a reduction of up to 50% of the monthly rent due for the |
19 | | purpose of enabling the recoupment of the lessee's authorized |
20 | | expenditures during the term of the lease.
|
21 | | (k) To sell surplus agricultural products grown on land |
22 | | owned by or
under the jurisdiction of the Historic Sites and |
23 | | Preservation Division of
the Agency, when the
products cannot |
24 | | be used
by the Agency.
|
25 | | (l) To enforce the laws of the State and the rules and |
26 | | regulations of the
Agency in or on any lands owned, leased, or |
|

1 | | managed by the Historic Sites and
Preservation
Division of the |
2 | | Agency.
|
3 | | (m) To cooperate with private organizations and agencies of |
4 | | the
State of Illinois by providing areas and the use of staff |
5 | | personnel
where feasible for the sale of publications on the |
6 | | historic and cultural
heritage of the State and craft items |
7 | | made by Illinois craftsmen. These
sales shall not conflict with |
8 | | existing concession agreements. The
Historic Sites and |
9 | | Preservation Division of the Agency is authorized to
negotiate |
10 | | with the
organizations and
agencies for a portion of the monies |
11 | | received from sales to be returned
to the Historic Sites and |
12 | | Preservation Division of the Agency's Historic
Sites Fund
for |
13 | | the
furtherance of interpretive
and restoration programs.
|
14 | | (n) To establish local bank or savings and loan association
|
15 | | accounts, upon the written authorization of the Director, to |
16 | | temporarily
hold income received at any of its properties. The |
17 | | local accounts
established under this Section shall be in the |
18 | | name of the Historic
Preservation Agency and shall be subject |
19 | | to regular audits. The balance in
a local bank or savings and |
20 | | loan association account shall be forwarded to
the Agency for |
21 | | deposit with the State Treasurer on Monday of each week if
the |
22 | | amount to be deposited in a fund exceeds $500.
|
23 | | No bank or savings and loan association shall receive |
24 | | public funds as
permitted by this Section, unless it has |
25 | | complied with the requirements
established under Section 6 of |
26 | | the Public Funds Investment Act.

|
1 | | (o) To accept, with the consent of the Board, offers of |
2 | | gifts,
gratuities, or grants from the federal
government, its |
3 | | agencies, or offices, or from any person, firm, or
corporation.
|
4 | | (p) To make reasonable rules and regulations as may be |
5 | | necessary to
discharge the duties of the Agency.
|
6 | | (q) With appropriate cultural organizations, to further |
7 | | and advance the
goals of the Agency.
|
8 | | (r) To make grants for the purposes of planning, survey, |
9 | | rehabilitation,
restoration, reconstruction, landscaping, and |
10 | | acquisition of Illinois
properties (i) designated individually |
11 | | in the National
Register of Historic Places, (ii) designated as |
12 | | a landmark under a county or
municipal landmark ordinance, or |
13 | | (iii) located within a National Register of
Historic Places |
14 | | historic district or a locally designated historic district
|
15 | | when the Director determines that the property is of historic |
16 | | significance
whenever an
appropriation is made therefor by the |
17 | | General Assembly or whenever gifts or
grants are received for |
18 | | that purpose and to promulgate
regulations as may be necessary |
19 | | or desirable to carry out the purposes
of the grants.
|
20 | | Grantees may, as prescribed by rule, be required to provide |
21 | | matching funds
for each grant. Grants made under this |
22 | | subsection shall be known as Illinois
Heritage Grants.
|
23 | | Every owner of a historic property, or the owner's agent, |
24 | | is eligible to
apply for a grant under this subsection.
|
25 | | (s) To establish and implement a pilot program for charging |
26 | | admission to
State historic sites. Fees may be charged for |
|

|
1 | | special events, admissions, and
parking or any combination; |
2 | | fees may be charged at all sites or selected sites.
All fees |
3 | | shall be deposited into the Illinois Historic Sites Fund. The
|
4 | | Historic Sites and Preservation Division of the Agency
shall |
5 | | have the discretion to set and adjust reasonable fees at the |
6 | | various
sites, taking into consideration various factors |
7 | | including but not limited to:
cost of services furnished to |
8 | | each visitor, impact of fees on attendance and
tourism and the |
9 | | costs expended collecting the fees. The
Agency shall keep
|
10 | | careful records of the income and expenses resulting from the |
11 | | imposition of
fees, shall keep records as to the attendance at |
12 | | each historic site, and shall
report to the Governor and |
13 | | General Assembly by January 31 after the close of
each year. |
14 | | The report shall include information on costs, expenses,
|
15 | | attendance, comments by visitors, and any other information the
|
16 | | Agency may
believe pertinent, including:
|
17 | | (1) Recommendations as to whether fees should be |
18 | | continued at each State
historic site.
|
19 | | (2) How the fees should be structured and imposed.
|
20 | | (3) Estimates of revenues and expenses associated with |
21 | | each site.
|
22 | | (t) To provide for overnight tent and trailer campsites and |
23 | | to provide
suitable housing facilities for student and juvenile |
24 | | overnight camping
groups. The Historic Sites and Preservation |
25 | | Division of the Agency shall
charge rates similar to those
|
26 | | charged by the Department
of Conservation for the same or |
|

|
1 | | similar facilities and services.
|
2 | | (u) To engage in marketing activities designed to promote |
3 | | the sites and
programs administered by the Agency. In
|
4 | | undertaking these activities, the
Agency may take all necessary |
5 | | steps with respect
to products and services,
including but not |
6 | | limited to retail sales, wholesale sales, direct marketing,
|
7 | | mail order sales, telephone sales, advertising and promotion, |
8 | | purchase of
product and materials inventory, design, printing |
9 | | and manufacturing of new
products, reproductions, and |
10 | | adaptations, copyright and trademark licensing and
royalty |
11 | | agreements, and payment of applicable taxes. In addition, the |
12 | | Agency
shall have the authority to sell advertising in its |
13 | | publications and printed
materials. All income from marketing
|
14 | | activities shall be deposited into the Illinois Historic Sites |
15 | | Fund.

18 | | Sec. 22. Amistad Commission. |
19 | | (a) Purpose. The General Assembly finds and declares that |
20 | | all people should know of and remember the human carnage and |
21 | | dehumanizing atrocities committed during the period of the |
22 | | African slave trade and slavery in America and of the vestiges |
23 | | of slavery in this country; and it is in fact vital to educate |
24 | | our citizens on these events, the legacy of slavery, the sad |
25 | | history of racism in this country, and the principles of human |

|
1 | | rights and dignity in a civilized society. |
2 | | It is the policy of the State of Illinois that the history |
3 | | of the African slave trade, slavery in America, the depth of |
4 | | their impact in our society, and the triumphs of |
5 | | African-Americans and their significant contributions to the |
6 | | development of this country is the proper concern of all |
7 | | people, particularly students enrolled in the schools of the |
8 | | State of Illinois. |
9 | | It is therefore desirable to create a Commission that, as |
10 | | an organized body and on a continuous basis, will survey, |
11 | | design, encourage, and promote the implementation of education |
12 | | and awareness programs in Illinois that are concerned with the |
13 | | African slave trade, slavery in America, the vestiges of |
14 | | slavery in this country, and the contributions of |
15 | | African-Americans in building our country; to develop |
16 | | workshops, institutes, seminars, and other teacher training |
17 | | activities designed to educate teachers on this subject matter; |
18 | | and that will be responsible for the coordination of events on |
19 | | a regular basis, throughout the State, that provide appropriate |
20 | | memorialization of the events concerning the enslavement of |
21 | | Africans and their descendants in America and their struggle |
22 | | for freedom, liberty, and equality. |
23 | | (b) Amistad Commission. The Amistad Commission is created |
24 | | within the Agency. The Commission is named to honor the group |
25 | | of enslaved Africans transported in 1839 on a vessel named the |
26 | | Amistad who overthrew their captors and created an |
|

|
1 | | international incident that was eventually argued before the |
2 | | Supreme Court and that shed a growing light on the evils of the |
3 | | slave trade and galvanized a growing abolitionist movement |
4 | | towards demanding the end of slavery in the United States. |
5 | | (c) Membership. The Commission shall consist of 15 members, |
6 | | including 3 ex officio members: the State Superintendent of |
7 | | Education or
his or her designee, the Director of Commerce and |
8 | | Economic Opportunity or his or her designee, and the Director |
9 | | of the Historic Sites and Preservation Agency or his or her |
10 | | designee; and 12 public
members. Public members shall be |
11 | | appointed as follows: |
12 | | (i) 2 members appointed by the President of the Senate |
13 | | and one member appointed by the Minority Leader of the |
14 | | Senate;
|
15 | | (ii) 2 members appointed by the Speaker of the House of |
16 | | Representatives and one member appointed by the Minority |
17 | | Leader of the House of Representatives; and
|
18 | | (iii) 6 members, no more than 4 of whom shall be of the |
19 | | same political party, appointed by the Governor.
|
20 | | The public members shall be residents of this State, chosen |
21 | | with due regard to broad geographic representation and ethnic |
22 | | diversity, who have served actively in organizations that |
23 | | educate the public on the history of the African slave trade, |
24 | | the contributions of African-Americans to our society, and |
25 | | civil rights issues. |
26 | | Each public member of the Commission shall serve for a term |

1 | | of 3 years, except that of the initial members so appointed: |
2 | | one member appointed by the President of the Senate, one member |
3 | | appointed by the Speaker of the House of Representatives, and 2 |
4 | | members appointed by the Governor shall serve for terms of one |
5 | | year; the member appointed by the Minority Leader of the |
6 | | Senate, one member appointed by the Speaker of the House of |
7 | | Representatives, and 2 members appointed by the Governor shall |
8 | | serve for terms of 2 years; and one member appointed by the |
9 | | President of the Senate, the member appointed by the Minority |
10 | | Leader of the House of Representatives, and 2 members appointed |
11 | | by the Governor shall serve for terms of 3 years. Public |
12 | | members shall be eligible for reappointment. They shall serve |
13 | | until their successors are appointed and qualified, and the |
14 | | term of the successor of any incumbent shall be calculated from |
15 | | the expiration of the term of that incumbent. A vacancy |
16 | | occurring other than by expiration of term shall be filled in |
17 | | the same manner as the original appointment, but for the |
18 | | unexpired term only. |
19 | | (d) Election of chairperson; meetings. At its first meeting |
20 | | and annually thereafter, the Commission shall elect from among |
21 | | its members a chairperson and other officers it considers |
22 | | necessary or appropriate. After its first meeting, the |
23 | | Commission shall meet at least quarterly, or more frequently at |
24 | | the call of the chairperson or if requested by 9 or more |
25 | | members. |
26 | | (e) Quorum. A majority of the members of the Commission |

|
1 | | constitute a quorum for the transaction of business at a |
2 | | meeting of the Commission. A majority of the members present |
3 | | and serving is required for official action of the Commission. |
4 | | (f) Public meeting. All business that the Commission is |
5 | | authorized to perform shall be conducted at a public meeting of |
6 | | the Commission, held in compliance with the Open Meetings Act. |
7 | | (g) Freedom of Information. A writing prepared, owned, |
8 | | used, in the possession of, or retained by the Commission in |
9 | | the performance of an official function is subject to the |
10 | | Freedom of Information Act. |
11 | | (h) Compensation. The members of the Commission shall serve |
12 | | without compensation, but shall be entitled to reimbursement |
13 | | for all necessary expenses incurred in the performance of their |
14 | | official duties as members of the Commission from funds |
15 | | appropriated for that purpose. Reimbursement for travel, |
16 | | meals, and lodging shall be in accordance with the rules of the |
17 | | Governor's Travel Control Board. |
18 | | (i) Duties. The Commission shall have the following |
19 | | responsibilities and duties:
|
20 | | (1) To provide, based upon the collective interest of |
21 | | the members and the knowledge and experience of the |
22 | | members, assistance and advice to schools within the State |
23 | | with respect to the implementation of education, awareness |
24 | | programs, textbooks, and educational materials concerned |
25 | | with the African slave trade, slavery in America, the |
26 | | vestiges of slavery in this country, and the contributions |

|
1 | | of African-Americans to our society. |
2 | | (2) To survey and catalog the extent and breadth of |
3 | | education concerning the African slave trade, slavery in |
4 | | America, the vestiges of slavery in this country, and the |
5 | | contributions of African-Americans to our society |
6 | | presently being incorporated into the curricula and |
7 | | textbooks and taught in the school systems of the State; to |
8 | | inventory those African slave trade, American slavery, or |
9 | | relevant African-American history memorials, exhibits, and |
10 | | resources that should be incorporated into courses of study |
11 | | at educational institutions, schools, and various other |
12 | | locations throughout the State; and to assist the State |
13 | | Board of Education and
other State and educational agencies |
14 | | in the development and implementation of African slave |
15 | | trade, American slavery, and African-American history |
16 | | education programs. |
17 | | (3) To act as a liaison with textbook publishers, |
18 | | schools, public, private, and nonprofit resource |
19 | | organizations,
and members of the United States Senate and |
20 | | House of
Representatives and the Illinois Senate and House |
21 | | of Representatives in
order to facilitate the inclusion of |
22 | | the history of African slavery and
of African-Americans in |
23 | | this country in the curricula of public and
nonpublic |
24 | | schools. |
25 | | (4) To compile a roster of individual volunteers who |
26 | | are willing to share their knowledge and experience in |

|
1 | | classrooms, seminars, and workshops with students and |
2 | | teachers on the subject of the African slave trade, |
3 | | American slavery, the impact of slavery on our society |
4 | | today, and the contributions of African-Americans to our |
5 | | country. |
6 | | (5) To coordinate events memorializing the African |
7 | | slave trade, American slavery, and the history of |
8 | | African-Americans in this country that reflect the |
9 | | contributions of African-Americans in overcoming the |
10 | | burdens of slavery and its vestiges, and to seek volunteers |
11 | | who are willing and able to participate in commemorative |
12 | | events that will enhance student awareness of the |
13 | | significance of the African slave trade, American slavery, |
14 | | its historical impact, and the struggle for freedom. |
15 | | (6) To prepare reports for the Governor and the General |
16 | | Assembly regarding its findings and recommendations on |
17 | | facilitating the inclusion of the African slave trade, |
18 | | American slavery studies, African-American history, and |
19 | | special programs in the educational system of the State.
|
20 | | (7) To develop, in consultation with the State Board of |
21 | | Education, curriculum guidelines that will be made |
22 | | available to every school board for the teaching of |
23 | | information on the African slave trade, slavery in America, |
24 | | the vestiges of slavery in this country, and the |
25 | | contributions of African-Americans to our country.
|
26 | | (8) To solicit, receive, and accept appropriations, |
|

|
1 | | gifts, and donations for Commission operations and |
2 | | programs authorized under this Section.
|
3 | | (j) Commission requests for assistance. The Commission is |
4 | | authorized to call upon any department, office, division, or |
5 | | agency of the State, or of any county, municipality, or school |
6 | | district of the State, to supply such data, program reports, |
7 | | and other information, appropriate school personnel, and |
8 | | assistance as it deems necessary to discharge its |
9 | | responsibilities under this Act. These departments, offices, |
10 | | divisions, and agencies shall, to the extent possible and not |
11 | | inconsistent with any other law of this State, cooperate with |
12 | | the Commission and shall furnish it with such information, |
13 | | appropriate school personnel, and assistance as may be |
14 | | necessary or helpful to accomplish the purposes of this Act.
|
15 | | (k) State Board of Education assistance. The State Board of |
16 | | Education shall: |

used primarily as a grocery store by |
19 | | a commercial tenant during the term of
a lease that predates |
20 | | the University's acquisition of the premises; but the
|
21 | | University shall have no power or authority to renew, transfer, |
22 | | or extend
the lease with terms allowing the sale of alcoholic |
23 | | liquor; and the sale of
alcoholic liquor shall be subject to |
24 | | all local laws and regulations.
After the acquisition by |
25 | | Winnebago County of the property located at 404
Elm Street in |
26 | | Rockford, a commercial tenant who sold alcoholic liquor at
|

the acquisition may continue to do so for so long |

5 | | sale of alcoholic liquor. Alcoholic liquors may be delivered to |
6 | | and sold at Memorial Hall, located at 211 North Main Street, |
7 | | Rockford, under conditions approved by Winnebago County and |
8 | | subject to all local laws and regulations regarding the sale of |
9 | | alcoholic liquor. Each
facility shall provide dram shop |
10 | | liability in maximum insurance coverage
limits so as to save |
11 | | harmless the State, municipality, State university,
airport, |
12 | | golf course, faculty center, facility in which conference and
|
13 | | convention type activities take place, park district, Forest |
14 | | Preserve
District, public community college district, |
15 | | aquarium, museum, or sanitary
district from all financial loss, |
16 | | damage or harm. Alcoholic liquors may be
sold at retail in |
17 | | buildings of golf courses owned by municipalities or Illinois |
18 | | State University in
connection with the operation of an |
19 | | established food serving facility
during times when food is |
20 | | dispensed for consumption upon the premises.
Alcoholic liquors |
21 | | may be delivered to and sold at retail in any building
owned by |
22 | | a fire protection district organized under the Fire Protection
|
23 | | District Act, provided that such delivery and sale is approved |
24 | | by the board
of trustees of the district, and provided further |
25 | | that such delivery and
sale is limited to fundraising events |
26 | | and to a maximum of 6 events per year. However, the limitation |
|

5 | | if the alcoholic liquor is sold or dispensed as approved by the |
6 | | Oswego Fire Protection District and the property is no longer |
7 | | being utilized for fire protection purposes.

8 | | Alcoholic liquors may be served or sold in buildings under |
9 | | the control of the Board of Trustees of the University of |
10 | | Illinois for events that the Board may determine are public |
11 | | events and not related student activities. The Board of |
12 | | Trustees shall issue a written policy within 6 months of the |
13 | | effective date of this amendatory Act of the 95th General |
14 | | Assembly concerning the types of events that would be eligible |
15 | | for an exemption. Thereafter, the Board of Trustees may issue |
16 | | revised, updated, new, or amended policies as it deems |
17 | | necessary and appropriate. In preparing its written policy, the |
18 | | Board of Trustees shall, among other factors it considers |
19 | | relevant and important, give consideration to the following: |
20 | | (i) whether the event is a student activity or student related |
21 | | activity; (ii) whether the physical setting of the event is |
22 | | conducive to control of liquor sales and distribution; (iii) |
23 | | the ability of the event operator to ensure that the sale or |
24 | | serving of alcoholic liquors and the demeanor of the |
25 | | participants are in accordance with State law and University |
26 | | policies; (iv) regarding the anticipated attendees at the |
|

1 | | event, the relative proportion of individuals under the age of |
2 | | 21 to individuals age 21 or older; (v) the ability of the venue |

5 | | event prohibits participants from removing alcoholic beverages |
6 | | from the venue; and (vii) whether the event prohibits |
7 | | participants from providing their own alcoholic liquors to the |
8 | | venue. In addition, any policy submitted by the Board of |
9 | | Trustees to the Illinois Liquor Control Commission must require |
10 | | that any event at which alcoholic liquors are served or sold in |
11 | | buildings under the control of the Board of Trustees shall |
12 | | require the prior written approval of the Office of the |
13 | | Chancellor for the University campus where the event is |
14 | | located. The Board of Trustees shall submit its policy, and any |
15 | | subsequently revised, updated, new, or amended policies, to the |
16 | | Illinois Liquor Control Commission, and any University event, |
17 | | or location for an event, exempted under such policies shall |
18 | | apply for a license under the applicable Sections of this Act. |
19 | | Alcoholic liquors may be served or sold in buildings under
|
20 | | the control of the Board of Trustees of Northern Illinois |
21 | | University
for events that the Board may determine are public
|
22 | | events and not student-related activities. The Board of
|
23 | | Trustees shall issue a written policy within 6 months after |
24 | | June 28, 2011 (the

25 | | concerning the types of events that would be eligible
for an |
26 | | exemption. Thereafter, the Board of Trustees may issue

16 | | event prohibits participants from removing alcoholic beverages
|
17 | | from the venue; and (vii) whether the event prohibits
|
18 | | participants from providing their own alcoholic liquors to the
|
19 | | venue. |
20 | | Alcoholic liquors may be served or sold in buildings under |
21 | | the control of the Board of Trustees of Chicago State |
22 | | University for events that the Board may determine are public |
23 | | events and not student-related activities. The Board of |
24 | | Trustees shall issue a written policy within 6 months after |
25 | | August 2, 2013 ( the effective date of Public Act 98-132) this |
26 | | amendatory Act of the 98th General Assembly concerning the |

6 | | important, give consideration to the following: (i) whether the |
7 | | event is a student activity or student-related activity; (ii) |
8 | | whether the physical setting of the event is conducive to |
9 | | control of liquor sales and distribution; (iii) the ability of |
10 | | the event operator to ensure that the sale or serving of |
11 | | alcoholic liquors and the demeanor of the participants are in |
12 | | accordance with State law and University policies; (iv) the |
13 | | anticipated attendees at the event and the relative proportion |
14 | | of individuals under the age of 21 to individuals age 21 or |
15 | | older; (v) the ability of the venue operator to prevent the |
16 | | sale or distribution of alcoholic liquors to individuals under |
17 | | the age of 21; (vi) whether the event prohibits participants |
18 | | from removing alcoholic beverages from the venue; and (vii) |
19 | | whether the event prohibits participants from providing their |
20 | | own alcoholic liquors to the venue. |
21 | | Alcoholic liquors may be served or sold in buildings under
|
22 | | the control of the Board of Trustees of Illinois State |
23 | | University
for events that the Board may determine are public
|
24 | | events and not student-related activities. The Board of
|
25 | | Trustees shall issue a written policy within 6 months after the |
26 | | effective date of this amendatory Act of the 97th General |

15 | | of
21 to individuals age 21 or older; (v) the ability of the |
16 | | venue
operator to prevent the sale or distribution of alcoholic
|
17 | | liquors to individuals under the age of 21; (vi) whether the
|
18 | | event prohibits participants from removing alcoholic beverages
|
19 | | from the venue; and (vii) whether the event prohibits
|
20 | | participants from providing their own alcoholic liquors to the
|
21 | | venue. |
22 | | Alcoholic liquor may be delivered to and sold at retail in |
23 | | the
Dorchester Senior Business Center owned by the Village of |
24 | | Dolton if the
alcoholic liquor is sold or dispensed only in |
25 | | connection with organized
functions for which the planned |
26 | | attendance is 20 or more persons, and if
the person or facility |

6 | | any
building used as an Illinois State Armory provided:

7 | | (i) the Adjutant General's written consent to the |
8 | | issuance of a
license to sell alcoholic liquor in such |
9 | | building is filed with the
Commission;
|
10 | | (ii) the alcoholic liquor is sold or dispensed only in |
11 | | connection
with organized functions held on special |
12 | | occasions;
|
13 | | (iii) the organized function is one for which the |
14 | | planned attendance
is 25 or more persons; and
|
15 | | (iv) the facility selling or dispensing the alcoholic |
16 | | liquors has
provided dram shop liability insurance in |
17 | | maximum limits so as to save
harmless the facility and the |
18 | | State from all financial loss, damage or harm.
|
19 | | Alcoholic liquors may be delivered to and sold at retail in |
20 | | the Chicago
Civic Center, provided that:
|
21 | | (i) the written consent of the Public Building |
22 | | Commission which
administers the Chicago Civic Center is |
23 | | filed with the Commission;
|
24 | | (ii) the alcoholic liquor is sold or dispensed only in |
25 | | connection with
organized functions held on special |
26 | | occasions;
|
|

harmless the Civic Center, the |
6 | | City of Chicago and the State from all
financial loss, |
7 | | damage or harm; and
|
8 | | (v) all applicable local ordinances are complied with.
|
9 | | Alcoholic liquors may be delivered or sold in any building |
10 | | belonging to
or under the control of any city, village or |
11 | | incorporated town where more
than 75% of the physical |
12 | | properties of the building is used for commercial
or |
13 | | recreational purposes, and the building is located upon a pier |
14 | | extending
into or over the waters of a navigable lake or stream |
15 | | or on the shore of a
navigable lake or stream.
In accordance |
16 | | with a license issued under this Act, alcoholic liquor may be |
17 | | sold, served, or delivered in buildings and facilities under
|
18 | | the control
of the Department of Natural Resources during |
19 | | events or activities lasting no more than 7 continuous days |
20 | | upon the written approval of the
Director of
Natural Resources |
21 | | acting as the controlling government authority. The Director
of

22 | | Natural Resources may specify conditions on that approval, |

6 | | a. the State park has overnight lodging facilities with |
7 | | some
restaurant facilities or, not having overnight |
8 | | lodging facilities, has
restaurant facilities which serve |
9 | | complete luncheon and dinner or
supper meals,
|
10 | | b. consent to the issuance of a license to sell |
11 | | alcoholic liquors in
the buildings has been filed with the |
12 | | commission by the Department of
Natural Resources, and
|
13 | | c. the alcoholic liquors are sold by the State park |
14 | | lodge or
restaurant concessionaire only during the hours |
15 | | from 11 o'clock a.m. until
12 o'clock midnight. |
16 | | Notwithstanding any other provision of this Act,

by Forest Preserve Districts |
14 | | with a population of less than 3,000,000 or
municipalities or |
15 | | park districts.

16 | | Alcoholic liquors may be sold at retail in the Springfield
|
17 | | Administration Building of the Department of Transportation |
18 | | and the
Illinois State Armory in Springfield; provided, that |
19 | | the controlling
government authority may consent to such sales |
20 | | only if
|
21 | | a. the request is from a not-for-profit organization;
|
22 | | b. such sales would not impede normal operations of the |
23 | | departments
involved;
|
24 | | c. the not-for-profit organization provides dram shop |
25 | | liability in
maximum insurance coverage limits and agrees |
26 | | to defend, save harmless
and indemnify the State of |

2 | | d. no such sale shall be made during normal working |

5 | | Alcoholic liquors may be sold at retail in buildings in |
6 | | recreational
areas of river conservancy districts under the |
7 | | control of, or leased
from, the river conservancy districts. |
8 | | Such sales are subject to
reasonable local regulations as |
9 | | provided in Article IV; however, no such
regulations may |
10 | | prohibit or substantially impair the sale of alcoholic
liquors |
11 | | on Sundays or Holidays.
|
12 | | Alcoholic liquors may be provided in long term care |
13 | | facilities owned or
operated by a county under Division 5-21 or |
14 | | 5-22 of the Counties Code,
when approved by the facility |
15 | | operator and not in conflict
with the regulations of the |
16 | | Illinois Department of Public Health, to
residents of the |
17 | | facility who have had their consumption of the alcoholic
|
18 | | liquors provided approved in writing by a physician licensed to |
19 | | practice
medicine in all its branches.
|
20 | | Alcoholic liquors may be delivered to and dispensed in |
21 | | State housing
assigned to employees of the Department of |
22 | | Corrections.
No person shall furnish or allow to be furnished |
23 | | any alcoholic
liquors to any prisoner confined in any jail, |
24 | | reformatory, prison or house
of correction except upon a |
25 | | physician's prescription for medicinal purposes.
