| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Section 11-704 as follows:
|
| 6 | | (625 ILCS 5/11-704) (from Ch. 95 1/2, par. 11-704)
|
| 7 | | Sec. 11-704. When overtaking on the right is permitted. (a) |
| 8 | | The driver of a vehicle with 3 or more wheels may overtake and |
| 9 | | pass
upon the right of another vehicle only under the following |
| 10 | | conditions:
|
| 11 | | 1. When the vehicle overtaken is making or about to make a |
| 12 | | left turn;
|
| 13 | | 2. Upon a roadway with unobstructed pavement of sufficient |
| 14 | | width for
two or more lines of vehicles moving lawfully in the |
| 15 | | direction being
traveled by the overtaking vehicle.
|
| 16 | | 3. Upon a one-way street, or upon any roadway on which |
| 17 | | traffic is
restricted to one direction of movement, where the |
| 18 | | roadway is free from
obstructions and of sufficient width for 2 |
| 19 | | or more lines of moving
vehicles.

| 20 | | (b) The driver of a 2 wheeled vehicle may not pass upon the |
| 21 | | right of any
other vehicle proceeding in the same direction |
| 22 | | unless the unobstructed
