AMENDMENT TO HOUSE BILL 3357

2    AMENDMENT NO. ______. Amend House Bill 3357 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Vulnerable Adults Abandonment Prevention Task Force Act.
 
6    Section 5. Vulnerable Adults Abandonment Prevention Task
7Force Act; members.
8    (a) There is created the Vulnerable Adults Abandonment
9Prevention Task Force (hereinafter referred to as the Task
10Force) to address the growing problem of vulnerable adults
11being left without regard for their mental or physical health,
12safety, or welfare. The Task Force shall consist of 14 members
13appointed as follows:
14        (1) 3 members of the Senate appointed by the President
15    of the Senate;
16        (2) 3 members of the Senate appointed by the Minority

1    Leader of the Senate;
2        (3) 3 members of the House of Representatives appointed
3    by the Speaker of the House of Representatives;
4        (4) 3 members of the House of Representatives appointed
5    by the Minority Leader of the House of Representatives; and
6        (5) 2 members appointed by the Governor one of whom
7    shall be designated the chairperson by the Governor.
8    (b) The members of the Task Force shall serve without
9compensation but shall be reimbursed for their reasonable and
10necessary expenses from funds appropriated for that purpose.
11    (c) The State of Illinois Council on Developmental
12Disabilities shall provide administrative and other support to
13the Task Force, and the Task Force shall also seek input from
14the Department of Human Services, the Department on Aging, and
15the Office of State Guardian. The Task Force shall consult with
16representatives of law enforcement, bar associations, and
17not-for-profits focused on persons with developmental
18disabilities, mental illness, and victims of elder abuse in the
19preparation of its final report.
20    (d) The Task Force shall conduct a study on the incidence
21of abandonment of vulnerable adults by persons and entities
22legally responsible to safeguard the mental or physical health,
23safety, or welfare of persons who are severely or profoundly
24intellectually disabled as a result of developmental
25disabilities, mental illness, dementia, or other similar
26incapacity and to make recommendations sufficient to protect

1these vulnerable adults, including the consideration of
2criminal penalties for the abandonment of these vulnerable
3adults without assuring adequate support or supervision.
4    (e) On or before January 1, 2014, the Task Force shall
5report its findings and recommendations to the General
6Assembly, by filing copies of its report as provided in Section
73.1 of the General Assembly Organization Act, and to the
8Governor.
9    (f) The Task Force is abolished on May 31, 2014.
 
10    Section 10. Repeal. This Act is repealed on June 1, 2014.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
