SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/20-52

    Amends the State Officials and Employees Ethics Act. Provides that if an Executive Inspector General determines that conduct at issue in a summary report resulted in the loss of public funds in an amount of $5,000 or more, then the Commission must make the report, or a redacted version of the report, available to the public. Authorizes the Commission to redact information in a report if it determines that the identity of any person named in the report is unnecessary. Provides that, prior to publication, the Commission shall permit the Executive Inspector General (rather than the Inspector General) to review documents to be made public and offer suggestions for redaction or provide a response that shall be made public with the summary report.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 20-52 as follows:
 
6    (5 ILCS 430/20-52)
7    Sec. 20-52. Release of summary reports.
8    (a) Within 60 days after receipt of a summary report and
9response from the ultimate jurisdictional authority or agency
10head, if the conduct at issue in the report that resulted in a
11suspension of at least 3 days or termination of employment, or
12if an Executive Inspector General determines that the conduct
13at issue in the report resulted in the loss of public funds in
14an amount of $5,000 or more, the Executive Ethics Commission
15shall make available to the public the report and response or a
16redacted version of the report and response. The Executive
17Ethics Commission may make available to the public any other
18summary report and response of the ultimate jurisdictional
19authority or agency head or a redacted version of the report
20and response.
21    (b) The Commission shall redact information in the summary
22report that may reveal the identity of witnesses, complainants,
23or informants or if the Commission determines that the identity

1of any person named in the report is unnecessary, or that it is
2appropriate to protect the identity of a person before the
3report is made public. The Commission may also redact any
4information it believes should not be made public. Prior to
5publication, the Commission shall permit the respondents, the
6Executive Inspector General, and Attorney General to review
7documents to be made public and offer suggestions for redaction
8or provide a response that shall be made public with the
9summary report.
10    (c) The Commission may withhold publication of the report
11or response if the Executive Inspector General or Attorney
12General certifies that releasing the report to the public will
13interfere with an ongoing investigation.
