Amends the Video Gaming Act. Provides that the governing body of a municipality or a county board of a county in which video gaming has not been prohibited may pass an ordinance to (1) limit the number of video gaming terminals permitted to operate within the boundaries of the municipality or the unincorporated areas of the county and (2) place restrictions on the locations of the video gaming terminals within the boundaries of the municipality or the unincorporated areas of the county, including, but not limited to, requiring a mandatory distance in feet between sets of video gaming terminals. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Video Gaming
Act is amended by adding |
5 | | Section 28 as follows: |
6 | | (230 ILCS 40/28 new) |
7 | | Sec. 28. Local ordinances. The governing body of a |
8 | | municipality or a county board of a county in which video |
9 | | gaming has not been prohibited pursuant to Section 27 or 70 of |
10 | | this Act may pass an ordinance to (1) limit the number of video |
11 | | gaming terminals permitted to operate within the boundaries of |
12 | | the municipality or the unincorporated areas of the county and |
13 | | (2) place restrictions on the locations of the video gaming |
14 | | terminals within the boundaries of the municipality or the |
15 | | unincorporated areas of the county, including, but not limited |
16 | | to, requiring a mandatory distance in feet between sets of |
17 | | video gaming terminals. |
18 | | An ordinance adopted under this Section shall not conflict |
19 | | with the powers and duties of the Illinois Gaming Board. |
20 | | Nothing in this Section shall be construed to grant |
21 | | authority to any entity to operate a video gaming terminal |
22 | | without a license under this Act.
