| | Amends the Public Officer Prohibited Activities Act. Prohibits a person required to file a statement of economic interest under certain provisions of the Illinois Governmental Ethics Act from knowingly employing or seeking to influence the employment or promotion of a relative in a position in the same unit of local government or school district. Defines "relative". Provides that violation of this Section is a Class A misdemeanor. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Public Officer Prohibited Activities Act is |
5 | | amended by adding Section 5 as follows: |
6 | | (50 ILCS 105/5 new) |
7 | | Sec. 5. Nepotism. |
8 | | (a) A person required to file a statement of economic |
9 | | interest under subsections (g), (h), (i), or (m) of Section |
10 | | 4A-101 of the Illinois Governmental Ethics Act shall not |
11 | | knowingly employ, or seek to influence the employment or |
12 | | promotion of, a relative in a position as an employee or |
13 | | independent contractor with the same unit of local government |
14 | | or school district. |
15 | | (b) For the purpose of this Section, a "relative" is a |
16 | | father, mother, son, daughter, brother, sister, husband, or |
17 | | wife. |
18 | | (c) A person is guilty of a Class A misdemeanor if that |
19 | | person intentionally violates any provision of this Section.

20 | | Section 99. Effective date. This Act takes effect upon |
21 | | becoming law.
