Amends the Illinois Vehicle Code. Provides that no person may smoke cigarettes, cigars, or pipes of any kind in a motor vehicle containing a minor under 13 years of age. Provides that a violation of this Section is a petty offense subject to a fine not to exceed $100. Provides that a violation of this Section is not cause to stop or search a motor vehicle or the driver of a motor vehicle.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by adding |
5 | | Section 11-1432 as follows: |
6 | | (625 ILCS 5/11-1432 new) |
7 | | Sec. 11-1432. Smoking in a motor vehicle with a minor |
8 | | present. |
9 | | (a) For the purposes of this Section, "smoke" means the |
10 | | possession of any lighted pipe, cigar, or cigarette of any kind |
11 | | or any other lighted smoking equipment or the lighting, |
12 | | inhaling, or exhaling of smoke from a pipe, cigar, or cigarette |
13 | | of any kind. |
14 | | (b) It shall be unlawful for a person to smoke in a motor |
15 | | vehicle, whether in motion or at rest, that contains a person |
16 | | younger than 13 years of age. |
17 | | (c) A person that violates this Section shall be guilty of |
18 | | a petty offense and subject to a fine not to exceed $100. |
19 | | (d) A law enforcement officer may not stop or search a
|
20 | | motor vehicle, its contents, the driver, or a passenger solely
|
21 | | because of a violation or suspected violation of this Section.
