1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Nurse Practice Act is amended by changing | ||||||
5 | Section 75-15 as follows: | ||||||
6 | (225 ILCS 65/75-15) (was 225 ILCS 65/17-15) | ||||||
7 | (Section scheduled to be repealed on January 1, 2018) | ||||||
8 | Sec. 75-15. Center for Nursing Advisory Board.

9 | (a) There is created the Center for Nursing Advisory Board, | ||||||
10 | which shall consist of 11 members appointed by the Governor, | ||||||
11 | with 6 members of the Advisory Board being nurses | ||||||
12 | representative of various nursing specialty areas. The other 5 | ||||||
13 | members may include representatives of associations, health | ||||||
14 | care providers, nursing educators, and consumers. The Advisory
| ||||||
15 | Board shall be chaired by the Nursing Act Coordinator, who | ||||||
16 | shall be a voting member of the Advisory Board. | ||||||
17 | (b) The membership of the Advisory Board shall reasonably | ||||||
18 | reflect representation from the geographic areas in this State. | ||||||
19 | (c) Members of the Advisory Board appointed by the Governor | ||||||
20 | shall serve for terms of 4 years, with no member serving more | ||||||
21 | than 10 successive years, except that, initially, 4 members | ||||||
22 | shall be appointed to the Advisory Board for terms that expire | ||||||
23 | on June 30, 2009, 4 members shall be appointed to the Advisory

1 | Board for terms that expire on June 30, 2008, and 3 members | ||||||
2 | shall be appointed to the Advisory Board for terms that expire | ||||||
3 | on June 30, 2007. A member shall serve until his or her | ||||||
4 | successor is appointed and has qualified. Vacancies shall be | ||||||
5 | filled in the same manner as original appointments, and any | ||||||
6 | member so appointed shall serve during the remainder of the | ||||||
7 | term for which the vacancy occurred. | ||||||
8 | (d) A quorum of the Advisory Board shall consist of a | ||||||
9 | majority of Advisory Board members currently serving. A | ||||||
10 | majority vote of the quorum is required for Advisory Board | ||||||
11 | decisions. A vacancy in the membership of the Advisory Board | ||||||
12 | shall not impair the right of a quorum to exercise all of the | ||||||
13 | rights and perform all of the duties of the Advisory Board. | ||||||
14 | (e) The Governor may remove any appointed member of the | ||||||
15 | Advisory Board for misconduct, incapacity, or neglect of duty | ||||||
16 | and shall be the sole judge of the sufficiency of the cause for | ||||||
17 | removal. | ||||||
18 | (f) Members of the Advisory Board are immune from suit in | ||||||
19 | any action based upon any activities performed in good faith as | ||||||
20 | members of the Advisory Board. | ||||||
21 | (g) Members of the Advisory Board shall not receive | ||||||
22 | compensation, but shall be reimbursed for actual traveling, | ||||||
23 | incidentals, and expenses necessarily incurred in carrying out | ||||||
24 | their duties as members of the Advisory Board, as approved by | ||||||
25 | the Department.

26 | (h) The Advisory Board shall meet annually to elect a |

1 | chairperson and vice chairperson. | ||||||
