| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Counties Code is amended by adding Section |
| 5 | | 5-1183 as follows:
|
| 6 | | (55 ILCS 5/5-1183 new) |
| 7 | | Sec. 5-1183. Donation bins. |
| 8 | | (a) Notwithstanding any other provision of law, a donation |
| 9 | | bin in any county shall have a permanent, written, printed |
| 10 | | label affixed to the bin and prominently displayed. The label |
| 11 | | shall include the name, address, and telephone number of the |
| 12 | | person or entity owning, operating, or maintaining that bin. |
| 13 | | Any entity that does not meet the criteria for a "not for |
| 14 | | profit" designation shall label its bin as "for profit". |
| 15 | | (b) As used in this Section: |
| 16 | | "Donation bin" or "bin" means a container or receptacle |

| 1 | | held out to the public as a place for people to drop off |
| 2 | | personal property and to store it until taken away. |
| 3 | | "Not for profit" means any entity that is officially |
| 4 | | recognized by the United States Internal Revenue Service as |
| 5 | | a tax-exempt entity described in Section 501(c)(3) of the |
| 6 | | Internal Revenue Code of 1986 (or any successor provision |
| 7 | | of federal tax law).

| 8 | | Section 10. The Illinois Municipal Code is amended by |
| 9 | | adding Section 11-42-15 as follows:

| 11 | | Sec. 11-42-15. Donation bins. |
