Amends the Consumer Fraud and Deceptive Business Practices Act.
Provides that it is an unlawful practice for a person to impose a surcharge upon a consumer who elects to pay by use of a credit card instead of making payment by cash, check, or similar means of payment. Effective immediately.

1 | | AN ACT concerning business transactions.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2QQQ as follows: |
6 | | (815 ILCS 505/2QQQ new) |
7 | | Sec. 2QQQ. Credit card surcharges prohibited. |
8 | | (a) No person in any sales transaction may impose a |
9 | | surcharge upon a consumer who elects to pay by use of a credit |
10 | | card instead of making payment by cash, check, or similar means |
11 | | of payment. |
12 | | (b) A violation of this Section constitutes an unlawful |
13 | | practice within the meaning of this Act.

14 | | Section 99. Effective date. This Act takes effect upon |
15 | | becoming law.
