2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Uniform Arbitration Act is amended by |
5 | | changing Section 3 as follows:
|

7 | | Sec. 3.
Appointment
of arbitrators.
|
8 | | If the arbitration agreement provides a method of |
9 | | appointment of
arbitrators, this this method shall be followed. |
10 | | In the absence thereof, any
method of appointment of |
11 | | arbitrators agreed upon by the parties to the
contract shall be |
12 | | followed. An arbitrator so appointed has all the powers
of one |
13 | | specifically named in the agreement. When an arbitrator |
14 | | appointed
fails or is unable to act, his successor shall be |
15 | | appointed in the same
manner as the original appointment. If |
16 | | the method of appointment of
arbitrators is not specified in |
17 | | the agreement and cannot be agreed upon by
the parties, the |
18 | | entire arbitration agreement shall terminate.
