Amends the Code of Civil Procedure. Provides that, when entering judgment for reasonable attorney's fees in any civil case under a statute permitting the prevailing party to recover reasonable
attorney's fees, the court shall use the Laffey Matrix prepared by the Civil Division of the United States Attorney's Office for the District of Columbia and adjusted using the Consumer Price Index for All Urban Consumers (CPI-U) for the Washington-Baltimore area. Excludes cases in which the hourly rate for attorney's fees is limited by statute.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Code of Civil Procedure is amended by adding |
5 | | Section 2-1307 as follows: |
6 | | (735 ILCS 5/2-1307 new) |
7 | | Sec. 2-1307. Attorney's fees; Laffey Matrix. |
8 | | (a) Except as otherwise provided in subsection (b), when |
9 | | entering judgment for reasonable attorney's fees in any civil |
10 | | case under a statute permitting the prevailing party to recover |
11 | | reasonable
attorney's fees, the court shall use the Laffey |
12 | | Matrix prepared by the Civil Division of the United States |
13 | | Attorney's Office for the District of Columbia and adjusted |
14 | | using the Consumer Price Index for All Urban Consumers (CPI-U) |
15 | | for the Washington-Baltimore area. |
16 | | (b) This Section does not apply in cases in which the |
17 | | hourly rate for attorney's fees is limited by statute.
